He definitely was resisting in the sense that he was refusing to comply. He should stop, lay down the stolen weapon, and put his hands in the air.

Does it require an aggressive response by themilitarypolice? Sure. That level of aggression? Oh hell no. Drive up real fast and hit him with a taser, or make it apparent that you WILL shoot if he does not stand down.
Criminals still deserve proper police procedure, regardless of how criminal they are, or may appear. Too much aggression will eventually turn this country against itself, and it will be a mess. I'm already inflamed enough by the typical police reactions in the past decade or two, I'm too chicken to take part in an aggressive response to the loss of our ideals. I admire our forefathers, but shit, that's a ton of risk.
