So now it's illegal to sell modchips, share info about "backing up" your games, and owning modchips? It sounds like selling the chips was a big offence, but why? What if you just got the modchip to put a larger HD on your xbox to do more game saves?(or something legetimate and legal) so what I'm asking is, what was illegal?

the part where he sold the modchips knowing they would be used to play pirated games was what got him.

Seems like he was arrested for selling mod chips, is that even illegal? He plead guilty to it.

under the dmca, anything to do with helping to / actually cracking security (in this case, the code that prevents the ps2/xbox from playing pirated games) is considered illegal. decss is one example. mod chips are another. a while back, there was an article on slashdot about how some researchers were afraid to present security flaws in software because they were afraid they would be able to be prosecuted under the dmca.

I think the DOJ busted Rocci because he was selling modchips using game piracy as a means for marketing his chips. I'm pretty sure modchip sales ARE legal, but you cannot use thier illegal means to market them. For instance, I can sell glass pipes for smoking tobacco, but if you pack weed in there it's your ass on the line. I cannot advetise, "Glass pipes for smoking bud.".

Nothing useful to download. I clearly missed the point.

It tells you what's out there and you have to download them youself from the usenet. That way you don't have to waste your time, checking usenet daily.

Virge gets it. The U.S. is slowly but surely declaring itself as a Police State under Military Doctrine Rules. They can take anything at any time for a reason they make up. The Constitution means nothing, not even worth the paper it is written on. No Amendments, Bill of Rights, No due process, just strict Military control just like the original Colonists rebeled against Dictator rules in the 1700's.

Axiom, be carfeful, you said possessing the glass pipe is legal until you stuff it with weed, WRONG, Ashcroft declared that simply possessing anything that can be used for Drugs will be prosecuted. This has Chemistry students worried about their Chemistry sets. The DEA has been on a rampage, where have you been? They have been shutting down and taking possesion of Gas Stations here in Gerogia that were selling the little glass tubes that hold mini Roses because they could be used for Drugs.

The site was causing the crime. I don't see whats wrong with taking the name. It was a tool of the crime.

Interesting to see people get busted for crimes that they didnt think they could get caught for. Im generally not a big fan of lawlessness. Perhaps if the Govt started fining or arresting people for downloading stuff on the net thats copyrighted, I could easily encourage others to stop.

Just go to the DOJ.gov site and it all spelled out clearly in black & white for you there. What's that saying people like to use here? All your Website belong to US.

No, mod chips aren't legal, because they can be used to circumvent the security built-in to the console. Of course, to test your theory you could call up the DOJ and ask there is any problem with you owning/buying a mod chip. They'll probably make an exception for you.

what makes modchips illegal are the bios on them. i don't really believe isonews.com was taken down mainly for them selling modchips. there are dozens of other modchip stores that sells way more "illegal" stuff but they have not been touched. they are probably unhappy that isonews is promoting and providing info about warez but they can't really bust them since the site is clean technically. so they stick em for modchip selling. as long as the site comes down, i dont think they care what reasons they use to prosecute him.
