you have it backwards, she DID attend phys ed. The disabled children did not. I assume, and the impression I get from the article, is that the GPAs of both her and the disabled students are equivalent if you completely knocked gym out of the question. So, it ends up being a matter of both her and the disabled students working hard at their grades. Although, in reality, it's prolly more likely those grades are a matter of massive sucking up to teachers.

The worst part is that her parents must be behind this as well, and it's even worse that her mother is a state Superior Court judge. What could someone expect from a judge like her?

well, the 2.5 million punis aren't supposed to be what it's worth to her. that's taken care of in the 200K compensatory damages. the 2.5 million is supposed to "punish" the school for committing such "egregious" behavior such that they'll think twice before doing the same thing again. all in all, though, i agree this is extremely silly.

Her school district looks at the disagreement another way: Because of an immune deficiency, Hornstine is classified as a disabled student and has taken a class load that doesn't include physical education and involves her spending part of her school day studying at home.

She did not take phys ed according to this quote.

Did she work hard to earn them? Yes
She obviously has a brilliant mind, the SAT score proves it
Prestigious colleges have accepted her, I doubt @ss-kissing got her that.
Last time I checked, SAT is scored by a computer, so that eliminates her putting out to the judges who score the SAT.
I may be wrong on this point, but I believe that a written essay of top notch quality is submitted in order to be accepted to the Ivy league schools, and they can spot plagerism a mile away.

Scott, the GPAs are not the same because P.E. lowered their GPA. It wasn't weighed as much. She got to use a class that had more weight intstead of PE and they were required to take it.

The valedictorian award is based on GPA, and GPA alone. That being said the fact that she did not have to take Phsy ed. and the other kids did meant that she would have a slightly higher GPA ( Phys. ED is not weighted) So no matter how good anyone else did it would be impossible for them to have as high a GPA as her. Three students did perfect in everything they took, 3 students in should get the award IMO. And on top of all that, if this girl is so intelligent then why doesn't she realize that a petty award like this isn't THAT big a deal anyway, and certainly not worth 2.5mil. She's gonna be a crappy lawyer if she thinks she can win this case.

And what of the others, say she hadn't been at the school, would they have complained about having to share? Or would they have been happy to get the damned thing?

So what happens if her LSAT scores are merely above average instead of exceptional . . . what about just passing the Bar . . . was she born a guiding light but now she deserves a dunce cap?!

I think you're missing the point. The point is not whether she worked hard or not. The point is that since she didn't have to take physical ed, her GPA is higher. For ppl that did have to take PE, even if they got an A+ in all PE courses, that would hurt their weighted GPA since PE is not weighted.

Example:
non PE student takes 2 weighted course: A (5 pts) + A (5pts) = 10, 10 / num of courses (2) = 5.0 GPA

PE student takes same courses, AND PE: A (5pts) + A (5pts) + A (4 pts cuz PE is not weighted) = 14, 14/3 = 4.66 GPA

How fair is that?

This is equally as dumb as the guy who sued the fast food chains because he became overweight. I went through a similar situation in high school, it's not about actually about the valedictorian but the class ranks.

My situation was, when I was a freshman I had almost ALL honors or AP classes, where applicable (not AP P.E. or SHOP :)) Well those grades got weighted, meaning I got a 4.00+. Now theres only 4 semesters or so that get weighted, so when I was a senior I got 4.0, non weighted, hindering my GPA and dropping my rank. Ok now, thats not freaking fair when these whiners took dorky regular classes and aced them all and then when junior and senior year comes along they take AP-honors classes and get 4.9+ GPA etc. Now people are all whining and crying about being #1 because blah and blah.

I ended up #15 :( but still got to the school I wanted to! woot!

My point is get rid of the stupid weight system!!!!

If all students got 4.0 GPA's, then great! Everyone rejoice!

God, she's already been accepted by Ivy league schools. Why give a f*ck about whose valedictorian or not? It's just HIGH SCHOOL!!!!!!

Exactly. I dunno if it's just a NJ thing, but basically if you are running with a high GPA and are competing to be valedictorian, you actually have to AVOID taking any non-honors/AP classes. If you have a ~5.0 GPA on a 4.0 scale, getting an "A" in a CP-track class can serve only to hurt your overall GPA.

It's hard for people to understand how taking a study hall can possibly be better for your grade than taking an easy-A elective like Concert Band, but that's the unfortunate way that it works.
