if pornography is legal, how is it that prostitution is illegal?

Hey, I've always wondered this. I did a search and so don't think this is a repost.

So, if person A goes out and pays person B to have sex with him/herself, that is illegal in 49 states, right?

well, what if person A goes tells person B to invite person C to have sex with person A (for money), and person A merely puts a video camera in the room and tapes the whole thing, and then sells the tape to even one person, lets say person B for a penny. Technically, that isn't prostitution then, is it? its porn, right? So thats legal, right?

I mean, porn stars don't 'do it' for free, they get paid to get laid. So whats the difference? They stick a video camera in the room or take still pictures and sell it to ppl, that makes it legal? or is it the fact that the person directly involved, person A, did'nt ask him/herself for the service from C, he went thru a 3rd party, person B (or a production company when you're talking about the Porn industry)?


I'm not planning on doing this, but have always wondered whats up with it, is this a flaw in our system, or what? any pre law students or lawyers know whats the deal?

Technicality. I actually saw this very same question on an episode of The Practice once. In porno, the sex is technically not done for pleasure, but for profit, while prostitution is done solely for pleasure. Why that makes porno legal, I have no idea.
 
i guess they could say they chose to have sex, and only got payed to be filmed..

and yeah. something like that i assume.
 
Porn industry is heavily regulated with medical examinations and STD tests, and all taxes are paid.

With prostitution, it's very difficult to monitor either of those. I'm not sure why prostitution is legal in Nevada. I don't know if it's because of very detailed paperwork or what.
 
so, in theory... you could "pay" someone to be filmed having sex with you, and it's legal. sounds like a bonus to me! 😀

State law allows for counties meeting certain population requirements (maximum population, thus large cities are out) to make their own laws regarding prostitution.

Only one county (or few, anyway) has chosen to legalize it, & it's only legal in state licensed brothels.

Okay, so basically, if there is a go between and that person gives person A even one penny, and C gets full 'hooker salary' so now that both parties are being paid, it is legal? All A has to do is tell the cops, "yeah, i did it for the money (1 cent)" i can't imagine why i used to see so many prostitution arrests on COPS then.. this is such a big loophole, any idiot can hire a prostitute and keep it 'legal' then.
 
they may as well legalize the practice. it ain't worth it. I'd rather see our taxpayer dollars going to catching rapists, serial killers, child abducters (so many of those lately.. sigh...), WHITE COLLLAR CRIMINALS (top of my hitlist right now... fck enron guys, fck mci guys, fck em all!), robbers, etc.

btw, i remember seeing a report on a brothel in Nevada, that county required them to have HIV testing and all that stuff and keep on top of their health records.

a lot of the younger pimped out prostitutes are nothing more than runaway teens that get addicted to drugs from a pimp and are just too drugged out to do anything about it...
 
Prostitution should NOT be illegal but heavily taxed and regulated.
STIFF (heeh) penalties for unlicensed prostitution.

Why try to legislate morality and human nature. We are human. We need sexual contact. A certain portion of us will have to seek it proffessionally.
Who cares?

Here in Australia it is legal and heavily regulated.
In my suburb alone, there are two brothels. They are in the 'industrial' section of town.
 
laws that attempt to force one's perception of "morality" onto others generally don't make sense anyways. laws should exist to protect people from other people, not protect them from committing what may be considered to be an "immoral" act.

I'm sure that the porn industry has to be regulated in some way. Come to think of it, wouldn't that be a great job? "Carry on girls, I'm just here to make sure both of you are following procedure."
