Hey, I've always wondered this. I did a search and so don't think this is a repost.
So, if person A goes out and pays person B to have sex with him/herself, that is illegal in 49 states, right?
well, what if person A goes tells person B to invite person C to have sex with person A (for money), and person A merely puts a video camera in the room and tapes the whole thing, and then sells the tape to even one person, lets say person B for a penny. Technically, that isn't prostitution then, is it? its porn, right? So thats legal, right?
I mean, porn stars don't 'do it' for free, they get paid to get laid. So whats the difference? They stick a video camera in the room or take still pictures and sell it to ppl, that makes it legal? or is it the fact that the person directly involved, person A, did'nt ask him/herself for the service from C, he went thru a 3rd party, person B (or a production company when you're talking about the Porn industry)?
I'm not planning on doing this, but have always wondered whats up with it, is this a flaw in our system, or what? any pre law students or lawyers know whats the deal?
