Well the 2500K was released January 2011, while the Maximus IV Gene3 was released in the Fall of 2011. I'm sure it would have the correct BIOS.

The auction listing shows a box. Given that is what the seller used, it is expected to come in an original manufacturer box, along with all the accessories (mainly the hsf). The listing description does not say the original box is missing.

Definitely sounds like INAD (item not as described).

If the listing isn't conclusive and upfront, i stay away. Too many shady sellers on ebay. This seller did not even take the effort to photograph the actual item (even if it's a crappy cell phone pic). Red flag right there. I don't know about leaving negative feedback before the issue is resolved. If he wasn't pissed off before, he sure is now, and will pull out all the stops to make your case more difficult.

That means its an i5-2500 if it said so on top of the cpu(derp). That should have been a huge red flag right when you saw that.

An i5-2500 is still a good cpu, but it doesnt have an unlocked multiplier for ocing which is the whole point of a 2500k. The sad part is, both cpu's almost cost the same price, but the 2500k has a huge advantage for ocing.

Make sure you take pictures of the top of the cpu and box to show ebay/paypal and the seller or you may not get your refund approved.....just fyi.

That's a shame. I never really trusted stock photos. I would rather demand actual photos of the things that I'm buying with time stamp. Without the K you're losing a better IGP, HD2000 on the Core i5 2500 and HD3000 on the K version. Also, the overclockability which is the feature that most look forward to when purchasing this chip.
This isn't just a stock photo mixup. The seller under comments lists it as a lightly used 2500k! This Buyer had every right to rely on that ad. Go through the Ebay system and hopefully this Seller will make the right call.

Well i filed a claim with Paypal...i also contacted the seller and here is a copy of his message back...

HIM- It is in fact a 2500k. I know that by how it looks u think its not. I had the same thoughts. I bought that new from newegg.com. Once installed i was able to see that was what I had ordered. If u install it u will see the same. And like i said i had it overclocked to 4.0 and was limited by my test board. With a better board and good cooling it could easily hit 4.6 and watercooling would more then likey see 5.0 and up.

ME-I have it installed with my Asus maximums mono and watercooling. The system settings is commingle up as a i5-2500. And it cannot be overclocked I truer the CPU is locked by Intel is what its saying. I also posted copies of my CPU info on anandtech forums and they all said its not a k series. This CPU is useless to me due to it being locked and UN overclockable.

HIM- Well either u r doing something wrong or have a board issue. I had it on both the gigabyte board and the asus maximus v formual board with no issues of overclock on either board. If i still had the screen shots from class i would send u them but that was 2 months ago's. I bought both boards to class for show of how different boards have different limitions. And r u sure that u r using the lga1155 socket board? Because i like said at home and even in class i have never had an issue other then the gigabyte limits to overclock.

that is about it......

My setup:
Asus Maximus IV Gen3/Version 2
128G SSD
Radeon 5770
Corsair Watercooling
Patriot Viper DDR3 RAM 18xxxHRZ
Windows 7 64bit

i can see by his "answers" that his is dodging my questions or nto even reading them...i stated in my first reply that i had a ASUS maximus IV Mobo...he keeps asking what kind of Mobo i have...

He is screwing you big time.... Push for full refund with PayPal. Also, you can use the Intel Processor ID to pull the actual model number.

In all honesty, I believe there is little difference performance-wise. The 2500k has a good chance of overclocking higher, and not running as hot, when going with a good overclock.

If buying now, like I did recently, just go with the best price. If you can wait, Haswell will be here in 6 months or less, and should offer a more noticeable performance boost (10% is the rumor.)
