You could text the phone - "Hi, I was in the hallway using the GPS locator on my phone. I called it and heard it beeping before you turned it off. Your address is (give address of building and not apartment). You have a choice: return it, or I will press charges & see you in small claims court to recover the full value of my phone. I'll give you a $20 reward for being honest and returning it."
Or, "Hi, I was in the hallway... " followed by a threat as to what you'll do to the person when they leave the building.

Yea I was pleading with the person via txt msg. He had to have seen the msg whenever he turned off my calls.
My speculation isn't baseless. I'm sure it's that quiet security guy at Laguna. Dave the doorman also says something rubs him the wrong way.

Isn't NSA spying at the root level (at the carrier/ISP)- similar to how whatever preventive measure we do with our browser doesn't do anything since NSA can extract info directly from ISP.
