That guy's insurance company is trying to drag this out so long that you give up and just pay everything on your own. That insurance company seems to be practicing some "shady" business...i'm sure that...if they didn't receive payment from the guy to renew insurance or whatever..they'd be able to get a hold of him right away...my friend was in a car accident not too long ago..*not her fault* and the other guy's insurance said they wouldn't be able to file a claim unless she had a bunch of information on the guy...so she decided to just pay for it herself so she wouldn't have to deal with the hassle. I say..don't give in..better yet..give 'em a piece of your mind if they can't seem to resolve this.. I think you could talk to your gf's insurance and have them contact the other guy's insurance, can't you?

She didn't have collision. They're out of the picture.

Since a police report was filed and the police spoke with the driver, it should be in the report who their insurance company is. Try contacting their insurance company.

They have legal reasons as to why they are not talking to you.... as for not being able to contact their employee... the truck driver might be on vacation.. out of the country... or some other lame reason. All I can say is get your GF to GET ON IT....

Inform them to take thir time, but they will be getting the bill for the $40 a day rental car as well.

There are issues of fraud... they might investigate to make sure it's not insurance fraud or a false claim. Think of it from the Business owners standpoint. Also, don't assume they have the same morals and ethics as you do. If one of your drivers [WHO DIDN'T THINK HE WAS IN AN ACCIDENT] was in an accident, wouldn't you want to make sure it was legit??

As to why they can't get a hold of their driver.... that's pretty lame.. however, do you know the size of the company? Maybe he's contracting? Maybe they are too busy... things get shoved to the back of the queue.. know what I mean??

My advice is to tell Viper GTS's girlfriend to GET ON IT.

I know they don't have to talk to me, that's fine. If I need to talk to them further I can get a notarized letter for them.

As far as I'm concerned we're past that point anyway.

I dunno if she'll go along though, when I told her we needed paperwork for filing a small claims suit she went & puked (literally). She wants to continue to deal with them.

Get a lawyer. You can also sue for the attorney costs so you won't be out any money. Or you could just file in Small Claims Court and forego the attorney but I'm not sure how well that'd work.

if they're based in florida, check FL first to see if they incorporated there, prob is they can be incorporated anywhere in the US.

most states will put their registered agent info on the web. Just go to the sec of state website, look for corporations or business, and there should be some sort of business search. or else try calling the secretary of state and see what they can release over the phone.

In Oregon, you file small claims suits at the county court house. I am not sure about Pennsylvania. It costs very little to file, takes a few hours out of your day for your court date, and makes the company very interested in settling.

I know, I told her she almost certainly wouldn't end up in court anyway, that once she filed they would suddenly become very willing to pay her.

I can't force her to do it, & I can't do it for her, so it's completely up to her. I'll do the research, I'll walk her through it, but she has to do it.

Aware or not it's hit and run, threaten to call the police and make a report to file criminal charges.

The driver is their agent, the company is responsible for what happens with their trucks, period.

This just gets better & better, I finally got ahold of the driver.

Told him who I was, let him know I was calling on behalf of Sarah, said "apparently you backed into her a few weeks ago" (just trying to let him know what it was in reference to). He immediately got defensive, said "That's what she's claiming, I know I didn't back up, & she never honked her horn or anything."

I asked him to call the people he's supposed to call, even offered to call them for him & conference them in (he declined).

So it would appear to me he intends to tell his company that he never backed up, which means they'll probably deny the claim.

If the cops caught up with the driver, he should have shown some form of insurance. You can get that info on the police report then file a claim with thier insurance company. Once you get a claim number and an address, send in a copy of the police report and the bill along with a demand letter. Their insurance company will look at it and note that their client was at fault. Then they'd contact him, then send you the check.

You guys are all trying to tackle this from the wrong direction. I say get a new GF and your problems are solved. especially one who won't puke at the thought of defending herself or her money in court ;)

Viper, dealing with the multi-state issue is going to be incredibly complex. I don't recommend you try.

What you need to do is get a copy of the police report. If the cop didn't write in the report that the guy hit her then you are likely SOL, it's going to be her word against his. If it is in the police report take the insurance information on it and submit a claim directly to the insurance company if they have one. If they are self-insured you are likely in for a world of hurt if you try to collect. Your only other option is to hire a lawyer and if the police report doesn't assign blame I doubt you can get one.

I'd go get a copy of that police report ASAP. Having one in my last accident (Where the other party was at fault, and then denied it to their insurance company) proved to be incredibly worthwhile.

My gf sounds a lot like yours, Viper. No action, very patient, etc. I have had to do battle with her landlord before, and fight Verizon a few times as well. Just make it known that she has two options, one of which will shut you up AND make the problem go away: 1) Give up and drive a f$cked up car, or 2) Let you take care of it.

call your own insurance company and have them deal with the f*cks

I didn't even read all the posts and this may have been suggested already, but all you have to do is get the car fixed and take the company to small claimis court. End of story. They are not, ever, going to cooperate with you.
