I have a huge Ebay problem, and I need everyone's advise :(

Alright guys here's the deal. I listed a Windows 2000 Professional on ebay, and it was bought now in about 3 hrs. That same night, I had a person e-mail me asking if I had any more of them, and I did. We agreed to 7 of them for a large amount of $. He sent the money paypal the next morning, w/ a Verified Paypal account. So I shipped the 7 of them in the box with Insurance, and delivery confirmation. Today he got the box, and this is what he wrote:

Hi Josh,

I got the package until today but It has only 5 five units instead of 7.

I bought you 7 units not 5. I'm sure it was a mistake so please ship
the other two units at the same address or give me a refund via paypal.

Please advise

There were 7 of them in the box, and it is obvious that he's just trying to screw me out of $$. What should I do? This is the first time something like this has ever happened to me

EDIT: Shipping weight was 9lbs. Each unit ways 1lb 1oz. That's a total of 7lb 7oz plus a 2lb? box. Not 5lb 5oz plus an almost 4lb box.

Did you specify that you were not responsible for lost or stolen mail?

Putting in such a disclaimer leaves the burden of proof upon him - he has to show that it wasn't stolen in the mail, and was your doing. In any case, this isn't something you'd ever go to court to, so such disclaimers, I guess, would be pointless.

The whole thing depends on how badly you want to protect your feedback. Do you feel you can live with his negative feedback?

Before telling him to screw off - send a carefully worded letter stating that you had placed all 7 in the box, and shipped the items to him. That aside from postal theft, the only answer is that he has miscounted the boxes (this has the effect of making it clear that you aren't buying his story, but without a direct accusation). Furthermore, state that you are not dishonest and that your excellent feedback (I assume its excellent) is a testament to that fact.
If he insists on screwing you, then you are going to have to swallow the bad feedback.

There's no way that he can affect my Feedback, b/c it was off of ebay. I'm just worried about this idiot going farther (paypal fraud, etc). I don't know if he would do such a idiotic thing, but seems like we know he's already an idiot

* If I were in the same position, I would compose a letter to him explaining that he was shipped (7) pieces. Unless someone opened the box and took (2), which is unlikely, you are not at liberty to compensate him any further.

Besides, doesn't he have to prove that you didn't send seven? Otherwise anyone could say, "they never sent such and such item...." I wouldn't worry about futher action. Even if you had only sent 5, he would have one heck of a time proving it. But, knowing you did send all seven, it will be impossible.

If you have anymore of them left, you can weigh one, multiply it by 7, then add the box. If there is no book in them tho they will be too light to make a difference. Otherwise the shipping cost might indicate the minimum weight for that cost, which might tell you that there had to be 7 in there.

Also, since you sent them in a box that holds 7 and he says he got 5, he's implying the box wasn't full or had some other packing material to fill the box. It would be interesting to know what he says about how they came, loose or packed, and if packed, what he says the packing material was to fill the empty space....

There's no way he can tell you everything was loose inside the box when you know it was packed full. I don't know if it proves anything but might be interesting to see what he says about that.

That is horrible man. Like the previous post, i think calculating the weight is a good solution. I'm not sure if you ever got the exact weight for the final shipping box. But if you did, you can just use total - weight of box divide by 7

I agree with the wieght idea. Find out what one box weighs, multiply that by 7, and add the packaging weight, and compare that to the shipping weight shown by USPS.

Otherwise, tell him to do an insurrance claim with USPS.

Some very, very good advice. That gives him a chance to back out of a lie, and leave you alone.

You have a chance to reply to negative feedback. When you choose to do so, a similarly carefully worded response that includes the fact another seller was accused of a similar mistake would be warranted. That should help keep any damage to a minimum.
