I got rear ended by a van *UPDATE*

Even with no-fault, if your insurance co can't recover the damages from the other guy's insurance, you'll have to pay your deductible and they'll pass the cost to your rates as well.
 
I just got back from the body shop.
Estimated damages are at $1490.43 CDN (!!) or $980.56 US.

The car is worth nowhere near that, so I dunno if he will pay. I might let him slide for say $800 CDN or so, I paid $600 for the car so that would cover the car and registration. If he doesn't want to pay that though then I will be filing a claim right away.

Dood, you are doing him a favor by not reporting it to your insurance (which I think you should do anyways)....I wouldn't let him off the hook at all..
 
i'd say go to the insurance, you won't feel your neck/back problems until tomorrow or later today

and to those that say he shoudl've called the cops, in SoCal (dunno wehre you're at) police wont' come to the scene of an accident unless somebody's injured
 
btw if you had called the cops they would have probably gave him a careless driving ticket and you would have gotten a police report.

the thing is, I don't have collision insurance so I won't get jack from my insurance company. 🙁

I'm gonna go to the clinic and get my neck checked out just in case. Depending on what they say I might just go to the insurance.. I do have injury compensation from them I think, up to $5000.
 
I just did a quick calculation and his car hitting me at 25mph was like a 2500lb car hitting me at 45mph.. that is if his van actually weighed 8000lbs. I dunno how much those things really weigh.

If you report to the insurance then you car is going to be bought by the insurance company for retail price before the collision. If you do the cash settlement you could find a bumper and lights cheap somewhere and have a car that is about them as before the collision plus somespare change.
 
file a police report and let your insurance cover it. you may also want to go see a doctor if you have any soreness (in case the soreness doesn't go away).
 
Unless things have changed since I moved from Montreal you should have filled out the accident form that the Regie (Sp?) issues. That way if the guy screws you and does not pay you can still go after him.

For all you call the cops fan. Forget it. The way to go is the form. Cops do not come for accidents like that.

DUDE!! YOU NEED TO FILE THIS WITH THE DMV ASAP!!! He for sure is going to file a report to the DMV saying YOU caused the accident. CALL THE DMV ASAP!!!!!!!!!!!!

I filled out most of the form, I don't have his reg/ins info (didn't think of taking it down..) except for license#, license plate, address etc.. i'm just waiting to see if he pays up first... since I won't get jack sh!t from insurance.

no you do call the cops at the scene of the accident. they come and they will make a report. the guy can still setle in cash and all but he can totaly screw you over if there is no proff and the only way for the cops to have proff is to go and see the acident site

wrong. cops will come if there's damage anywhere close to looking like it's over 500 bucks or if someone's injured
 
yeah seriously, whats up w/ you guys saying you don't call the cops at the scene of an accident? I rear ended someone because they slammed on their brakes at a yellow light, and there was snow and ice on the ground... when i got out of my car the chick in front of me was on her cell and i was like "calling the police?" and she nodded yes.

they came and took a report RIGHT THEN (actually an officer on his way to another accident showed up about 20 seconds after it happened, and he took the report)

i didn't get a ticket for following too closely or anything, but you ALWAYS call the cops to the scene of the accident so they can make a report...

i dunno about canada stuff tho
 
Well the guy doesn't want to pay up so I'm on the line with the insurance right now (on hold 🙂).

I'm going to go talk to his boss tomorrow (the owner of the vehicle) to make a report. He wants me to tell a different story to his boss than what actually happened. Sorry, but I don't work that way.

Maybe I should have called the cops. Meh.. I always thought you only did that if someone was hurt. Now I see it would have been a good idea. Anyway, it'd be pretty hard to pin it on me as that sort of damage only results one way.

Yep always call the cops. I had a Tractor Trailor hit me one time trying to force himself over into my lane cause he started to go down an off ramp. It didn't do any real damage, I think about $300 worth. It left a big dent in the rear passengerside back quarter of the car and a couple of black tire marks on the side.

When the cop got there he actually tried to lie and say i hit him. Of course with the damage on the side it was on, it was obvious he was lying and the cop didnt believe it.

I sited him for

Careless driving, Invalid Lane change, and Failure to yeild the right of way. Needless to say he didn't show up in court (cause he was from out of town, obviously), I did and he was found guilty of all charges.

Wonder if he's still driving? 😀

You only payed $600 for your car? WTF? lol. Must be one hell of a crappy car.

 
I rear-ended a car once because it was at night on a dark road under trees on a 45mph road and they had no brake lights or turn signal. Turns out, they were making a left turn and that's why they were stopped dead in the road. It was Christmas night and I was on my way to pick up my girlfriend to see a movie. The guys that I hit had installed a stereo that day and accidentally cut the brake lights. The driver got a ticket for not having insurance, one for not having a maintained vehicle, and one for not having a turn signal. I was considered 0% at fault by the police. Later, I found out the other insurance company declared me 20% negligent and my insurance company didn't bother to fight it because the damages were so little. (Their car sustained very minor damage and was already a piece of crap. My car had about $4000 in damages.)

Then, I was rear-ended this year the day before Thanksgiving. I already posted a few threads about it. It is probably one of the worst things to ever happen to me in my life. Also, it is the worst I've ever been injured.

that may be so, but it still got me from place to place at least until today. Actually it wasn't bad for what I paid.
 
getting rear-ended at a stop sign has got to be the dumbest thing in the world! did that guy think you weren't going to stop? i swear some people shouldn't be allowed to drive.
