I would assume that trying to get a license would be pretty difficult after a DUI and when you finally do get a license it would show on your record. Additionally, the issues with license suspension are only half of the case. The other side being legal which can/will involve fines, jail time, community service, court ordered classes, evaluations, etc.
I honestly don't understand how these types of laws can be put on the books.
Public intoxication is designed to keep people that are belligerent off the streets. It's not the same thing. You would never get arrested for PI unless you were starting fights, breaking things, pissing on things, etc. Nobody gets PI because they're walking home from the bar minding their own business, doing everybody a favor by not being on the road.
Which is it? Either you can be [outside of a building] after having a few beers, or you can't. According to this law, and if you take the public intoxication law literally, it may as well be against the law to drink alcohol anywhere except inside of your own home, or a hotel. 😕

A sober cyclist could have easily done the same thing, I see/have enough near misses going to and from work every day. And what does Acemcmac have to do with any of this?
Drunk driver killed Acemac. This wingnut could have killed someone by wandering into the path of a car. Dont tell me it happens all the time. I ride a bike 6 miles a day. I am careful and respect of cars. Being drunk dulls your senses and impairs your judgement. There is reason what so ever to drink and drive any thing.
I think there should be a different classification if you're on a bicycle...only because you're not piloting a ton or so of steel while drunk. But it's still serious, as you made the point you're more likely to swerve into traffic and cause someone ELSE to careen into a tree/others.

Thinking about it.. If you're drunk enough to be swerving into traffic and such on a bicycle, you should be charged with something. I take it back, that is going to be dangerous to other drivers.
It shouldn't be a DUI though. It should be public intoxication, just like if you were walking. Riding a bicycle should be considered walking as far as DUI laws go. If someone was walking in traffic drunk, they would be charged with PI. Both walking and riding a bicycle are human powered. It's just not the same as a car..... How unfair.

To everyone that's telling me to get a lawyer, thanks for the advice but I've been on that since this morning. One of my buddies might know someone on the county bar and my friends with experience in the local courts are already helping me find someone that can try and get this reduced. Does anyone know what actually constitutes being arrested? I was cuffed and taken to the station but I was never read my rights...so did I actually get arrested?

I was going to ravage you for DUI, but on a bicycle? You can get DUI for riding a lawn mower at 3 MPH or even a horse I think, so this isn't a surprise. You probably made the cop's night.
Honestly, good luck. There's a chance someone could have got hurt/killed trying to evade your drunkeness, so that's working against you.

It does happen though...someone in Port St. Lucie, Florida was given a DUI on his bike last year.
It's easy revenue. About $4-10k easy money and free publicity that the program is saving lives. The real benefit is pushing an action into law/policy by lumping them onto MADD/SADD issues.
I got a DUI because an ex-girlfriend of mine had my arrested in my parking space by a buddy cop. I ended up blowing a .168, I barely drank that night as I was at a club with very expensive drinks but a really awesome concert. My tab was in my pocket, I averaged not even a beer an hour.
I weighed about 180 (I am 5'11") at the time...it was equivalent to be pounding down a 6 pack.
Turns out the reason I failed was due to a open gash inside my lower lip where I ran into a shelf that day and bashed my teeth through it.
To defend myself would have been roughly 10-15k easy and I would still be subject to losing the case just based on the breath test anyway.
I paid it and it hasn't affected me since. My insurance, credit, etc have not been raised contrary to what MADD/SADD wants you to believe. My top rated insurance company's agent told me flat out they don't even consider a first time DUI in my area as there are so many of them and almost 100% have not resulted in any insurance claim.

Correct. We don't have to read you your rights unless we ask you questions pertaining to the reason you are arrested.
