I am representing a client who hit a drunk guy on a bicycle. My client was riding a motocycle on a 4 lane road and the drunk idiot was going the wrong way in the middle of the road. While the bicycle rider wasn't injured my client had to lay down his bike and shattered his right arm and right leg.

The fucked up thing is that the other guy was an illegal immigrant, has no insurance, and probably not even a valid address, was charged with a DUI under the state's motor vehicle code BUT my client's own UM/UI insurance won't pay for his hospitalization/therapy since they claim a bike is not a motor vehicle. :confused:

Agreed. And people wonder why there is a continual decline in respect for the law. When the law is clownshoes no one is going to respect.

unless OP is perhaps well known to the local cops and they want to fuck with him, actually arressting someone for this, especially as there was no other "vehicle" or person is involved is BS.

i ride my bike on the sidewalk all the time, why don't they arrest me for reckless endangerment?

Note - I don't agree with the cops busting the OP as they could have handled it a lot better.

i almost got a DUI for walking home drunk - public intoxication was the excuse but i convinced them to let me call a friend

I understand why biking while intoxication is illegal, it is possible for someone to swerve into on comming traffic. But the circumstances matter too. This happened in a really small town where the only cars on the street at night are cops and drunk college kids trying to drive back from the bars. I just happened to be in the wrong place at the wrong time. But I guess once I get through with this I'm only gonna walk from now on.

I'm sorry, but any state that carries the same punishment for a DUI on a bicycle as if you were driving a car is retarded.

I was going to yell at your for drinking and driving, but on a bike that's completely stupid. If the laws are in place to keep others on the road safe then you shouldn't be getting this charge on a bike.

i don't think you should have been charged a DUI either. a good laywer will get this reduced or even thrown out.

DUI on a bicycle is absolutely fucking ridiculous. Period. It is not the same thing in any way, shape or form.

The reason DUI in a car is so dangerous is because a car is a 3,000lb missile capable of traveling at 80-100 miles per hour or more..

If you're drunk and get your ass run over on a bicycle, it's your own damn fault. It's not dangerous to another car driver at all. The car is obviously going to win.

Unless said driver is the type of person that will swerve off a cliff to avoid hitting an animal. :roll:
