There comes a point when knowledge and permission of crime must be considered a crime itself if the system is to deter the action. This is why people who witness a murder and do not inform the authorities are accomplices. It is called aiding and abetting.
Actions require intent. If someone performs a criminal action with a tool, then they are guilty of the crime. Not their tool. Guns don't kill people, fatty fast food, cigarettes, and lack of exercise kills people. At least in America.
