How does it work to fight a speeding ticket?

Hey guys I got a speeding ticket doing 70 in a 60. I have never had a ticket before and the cop didn't even give me a warning. I got a ticket on the bottom of a hill before it started back up. I figured I would just let gravity slow me back down as I went up the hill and boom there was the cop...

Any suggestions how I can fight this and get it thrown away?

just dress well and show up in court..

since it's your first offense.. they probably wont give you any points.

but your fine willl be much higher..

they'll probably change the ticket to something else... possibly a non-moving violation...

the system is a business~ as it shouldn't be....
they need money like any other business~ ;)

hopefully you can get off with 0 points .. as that's what i think should be your main concern... but i doubt you'll get out of the ticket without paying~

$250 now (for the lawyer) will save you $$$ in the longrun between insurance rates going up and having points on your license.

Naw, you don't need a lawyer. SImply go to court. They will probably give you the option to pleading guilty to a lesser offense, like driving a defective vehicle(no points). If they don't offer you a deal, simply plead not guilty and they will set up a court date. If the officer doesn't show, voila, the ticket goes away.....if he does show up, you can always ask for lots of things like the maintenance records for the radar gun, laser gun, etc. I doubt it will go that far though....

i got burned REAL bad on my first speeding ticket. I *highly* suggest you seek the help of a lawyer.

It's extremely unlikely you will get this thrown out, go to traffic school (out here you can even do that online) and watch yourself on downhills ;)

I don't know how it is in other states, but here in Colorado they always offer you a deal to pay the ticket early. It is even printed on the ticket that if you pay it early, the charges will be dropped down to X(like defective vehicle). At the end of the day, all they really want is your money with a minimum of hassle or work on their part. Don't you just love it??!!

The point system is different in every state...but even if he doesn't receive points through the Secretary of State, he'll still probably get them through insurance. SEEK THE HELP OF A TRAFFIC LAWYER!!!!

It really depends what state you are in. 70 in a 60 is not a big deal in my area. In my experience, for a first time defender, they'll probably lower the speed over the limit you were travelling, resulting in no points. They may hit you with some more fines/court fees upfront than if you just paid the ticket, but its worth it as you won't get any points. Points are how your insurance company increase rates around the DC area. I wouldn't bother with a lawyer for a 70 over 60.

IMHO a lawyer would be a waste for a 10 mile an hour speeding ticket, but each to their own.......

Pay the fine.

If you go to court and lose (and you probably will), then you'll add the court costs to the fine.

why cant all the ticket problems tell us what state its in? it does you no good to come here and ask what to do if you dont tell us what state the ticket is in

The only real way to fight a ticket is to get a Lawyer.
You don't need a lawyer. When I went to court last time for a ticket, there was a court appointed defense lawyer on hand for everyone.

Whatever you do when you get a speeding ticket, opt to go to court. At the very least, you'll have to pay for the speeding ticket, but there is a good chance that the court will give you supervision, which is a hell of a lot better than just letting the ticket stick. It not only puts points on your driving record, but raises insurance premiums too.

If you're lucky, your cop won't even show up to court and they'll throw the ticket out. That's what happened to me last time. The cop didn't even show up that day.

What everbody isn't telling you is that you have the option of filing for an informal or a formal hearing. The informal is where you speak before a magistrate, and the formal is where you speak before a judge. Personally, i'd file for a formal and speak before a judge with your lawyer.

I'll stand by my statement...

My lawyer has told me..."In this day and age there absolutely no reason to ever have a traffic violation on your record."

There are even prepaid Lawyers that specialize in traffic court.

Take a chance or take control....at a price!

what about in california, for a 59 in a 45? can i pay the ticket and just go to traffic school to get the points removed from my record? i also read on the ticket i can do a trial by letter, where i write a letter voicing my case and it is decided by a judge from my letter vs. the cop's letter... do i have a chance? and if i lose this battle, will i still have the option of going to traffic school to remove the point? please hit me with lots of info if you can, guys... thanks

Don't bother fighting it.. you had no real reason to speed like that, and you're still obviously guilty.

I dont know what state or county you got your ticket in but in Sacramento County (and I think all of California) you do not get to take an attorney with you to traffic court.

I would suggest traffic school if it is available. It doesnt put a point on your record so your insurance shouldnt go up but you will have to pay money and spend a couple hours listening to someone yack yack yack. Some places they have "Traffic School With Humor".
