Yeah there's a difference, but it doesn't give her a right to hit me. A slap to the face was not self defense. She said she did it to "get him back to reality or whatever." That's not self defense. That is her being angry and escalating the situation. You don't hit someone unless they woke you up trying to hurt you. Being shaken awake and being cussed at is not grounds to hit someone. Why exactly are you arguing with quoted law here? The law has already been posted. If you want to talk about morality then they were both wrong as well. Either way you slice it they were both wrong. If she files a report she'll get arrested too.

That's not what happened. She said she was up talking to him and she didn't hit him until he was in her face yelling. Still illegal to do.
 
I do agree with you Mill, to a point. If a woman hits a man, ie, punches him in the face, then if she gets punched back, she gets what she is asking for. But, slapping someone is no call to punch someone so hard that you bruise them, especially in the chest, thats a dangerous spot to hit. And when that someone is alot smaller than you are, whether you are male or female, that has to be taken into account also. If a woman attacks a man, and he knocks her on her ass by pushing her down, good, it makes me sick when women do that and then cry abuse when the guy protects himself.

But punching someone that hard, who is that much smaller than you is overreacting. And, since we are pointing out facts of the story, he didn't punch her when she slapped him. He hit her when she tried to push him out the door, which means he had some time to recover from the slap, it wasn't just an instinctive reaction.

Well I never said that she deserved to get punched because she didn't. Neither one of them should have hit the other. A slap is still battery just like the hit, because the amount of force doesn't really matter in that situation. He shouldn't have hit her and she should not have hit me. The passage of the time and the like are not issues that would be considered legally. I'm speaking from a strictly legal viewpoint. In that viewpoint they both go to jail. All the mitigating factors in the world will not allow the police to NOT arrest them. Most police have had their discretion stripped from them in cases of domestic violence. If she had punched him in the face... she would still not have deserved to be hit back. Same with him. Had he punched her first he had no reason to hit her back. Neither of the blows sound like they were an intent to seriously harm the other party. Thus, it is a simple case of domestic violence with both people being charged with battery.

Letting emotions into this, and who was right... have nothing to do with what she asked. I would advise her to not file a police report, or remove her complaint if possible. In the eyes of the California law she could be arrested and charged with battery just like her ex-boyfriend. Domestic violence is a crime that is easily preventable. People need to learn to walk away and call the police. People are too concerned with their hurt feelings or being right and they end up in jail.

Legality aside... I think she should not have any further contact with him and make better decisions next time. I have no problems with Dezign and I hope nothing bad comes of what she did, but it is borderline insane for anyone to recommend that she file a police report. The laws states that should could be charged and convicted. I'd hate to go to jail over something that I could prevent. The law shifted over the years. It was the man was always right and the police didn't interfere. Then the woman was always right and the man was jailed. Now it is whoever hit the other(regardless of the timeline). So if they both hit each other the police normally arrest both. Now they really don't have a choice because most of the time they are required by law to make an arrest of anyone who battered the other.

People keep trying to argue out of a sense of morality or rightness of the situation. That isn't really applicable to filing a police report that can lead to your arrest. You think legality in those times and not what is proper and accepted.
