This article is inadequate to make a diagnosis (I'm in pediatric psychiatry); but this child definitely needs a psych eval (inpatient) not a jail cell. Technically you cannot detain unless a person is a likely danger to themselves or others. If this kid is such a risk to assault others he needs to be in a psychiatric facility where he can be treated not a correctional facility which rarely corrects anything.

The boy was recently released from a juvenile facility. The state doesnt know what to do with him,because hes considered highly likely to commit another offense.

What part of that blurb doesnt scream "A danger to himself and others."
We need to start infusing a little common sense into the Health and Human services Dept within our local governments, and allow for "preventative steps" in dealing with individuals who are determined to be a danger to themselves and others. I speak from experience, in that a child much like this one tried to choke my younger brother to death over a friggin pop-tart! Had it not been for our family dog taking the better part of this little morons arms and legs apart, my family might be minus one of its members.
