Today's ruling resolved the issue they where banking on to delay and drag out the fight, meaning the "until finally resolved by the courts" no longer exist because that delay tactic was eliminated today by the SCOTUS because it was resolved by the highest court in the land.

This ruling is a particularly fine bit of Schadenfreude. The US Supreme Court tells him that he is not a king. Even the Trump-appointed SCOTUS judges ruled according to law, not with who put them into their positions. Tumps Mafia way of doing things. The ruling was nearly unanimous, the only dissent coming, not from any of Trump’s nominees, but from Clarence Thomas, a man so deluded and incompetent that he’s unfit to be judging hogs at a county fair.
