Is getting incorporated and insured enough? Do I need permits?

From a B&M site? Cart? Where will you be selling? Will you have employees?

You almost certainly will need some type of business permit and a health inspection (sanitation).

Keep in mind that whatever permits, approvals, etc. you fail to obtain, your competitors will point out to the authorities.

Just to people in my building(big building) and maybe the surrounding buildings. Its just me for now

If I get the cert, can I do direct deliveries from my home? Not sure but I read that you can't do that. Am I wrong?

Before I get in contact with a fruit supplier or design the menu, I want to get the legal issues out of the way

Hire a lawyer. Asking for this sort of advice from anonymous strangers on the internet ends with you in jail for multiple violations of municipal health codes.

Can we get a picture of where you plan to locate? I'll probably stop by on my next trip to NYC, assuming you're still open. I believe they say most businesses fail within the first year. You negotiated a good lease and location I'm assuming? I'd like to know the details of this adventure you're taking, both the good and bad. Start a blog maybe?

Retail is such high risk. Delivering to your consumers from a food truck sounds like a good idea and lower risk.

We need more drama in AT, I'd say he should start this business solely based on our advice and see what happens.

Somebody with your mental capacity (and state) should not be selling food.

as long as OP records and posts all interactions with angry customers and/or police i'm okay with this.

Why not seriously consider getting a job with someone who already sells smoothies (or similar) locally ?

Then after a period of time (such as a year or two), you will be in a much better (experienced) position, to consider doing this, yourself.
