No sympathy here either, had some retarded 19 year old run a red and crack my collar bone. I totalled their car though and I got $4000 repair on mine plus $5000 cash, so, it could have been worse for you.

having said that, thank you to the guys who actually are trying to suggest helpful ways to get out of this.

the ticket will most likely be around $300 and i'll probably get it in a few weeks, it's not worth getting a lawyer, but it is worth getting some research and info on what exactly is going on with red-light cameras.

i'll probably end up having to pay the fine, but we'll see what happens. mostly i'm just worried about my insurance premiums going up.

I believe that since it is mechanized that it is a FINE only and they are not allowed to put the infraction on your record to count against you in points and Insurance.

I may be wrong so you should consult with a traffic or the Court in your area or even a Lawyer that is an expert on Traffic cases in your area.

Last evening, I did see an SUV running a light - and then I saw the flash for the picture. Laughed my ass off.

I did hear of a few people who beat the photo tickets in No. VA once........but it was a unique situation........cops were in the intersection directing traffic and they'd forgotten to change the lights from normal function to flashing. (While the lights are flashing, the photo is disabled.) As the cop directed the cars to go through, if it was red when they went through, the photo machine took their pic and all the drivers got tickets a week later.

Fortunately, each and every pic showed the cop in the intersection directing the traffic to go through. All the tickets got thrown out.....after some gnashing of teeth in the Post and on radio talk shows.

Your case, on the other hand, is cut-and-dried. You're going to pay. From wht I understand, most of the "questions" about the photo tickets revolves around the decision to shorten the yellow-light duration and having it turn red quicker. But, if it's not in question in your disctrict's court, you've got no legal legs. I have yet to hear of anyone actually beating these tickets.

And as far as claiming someone else was driving........they are ticketing the car, not the driver. Unfortunately, if points are assigned, the owner suffers. But, to the revenue collectors, it matters not one whit who was driving, just that the car broke the law and a healthy fine can and is collected.

Alot of the people on this board are nazis when it comes to traffic tickets. They seem to forget that $300 they charge you for the ticket is more of a crime.....just because it's law and the state does it doesn't make it right.

Anyway how to get out of it....DON'T WAIVER THE TICKET. You're simply throwing your money away to the state. Go to court and plead INNOCENT. At this point they will schedule another court date to hear your case. The reason they can't do your case on the intial court date is because 99% of people don't fight traffic tickets and when they do the courts are NEVER prepared.

When it comes time for your second court...like say the day before call the court up resecedule the court date...say it's a family emergency or something. The state needs a witness for their case against you, this will most likely be a cop (maybe the one that looks at the pictures?). The delay will cause the court to have to send another notice to the officer to appear. When your new court date finally comes hopefully the officer won't show (VERY, VERY, VERY COMMON). If he doesn't show the state has no case...YOU WIN.

The VERY WORST thing that can happen is the officer shows...you loose and you pay the $300. You may even get a nice judge who will reduce the fine.

I believe you may have a point, unless the ticket that comes in the mail asks you to remit your drivers license #, at which point you're screwed. I doubt you'd have an easy time fighting that ticket, since those things are computerized.

if the light was orange as you entered the intersection, you wont get one.
However if it was red already, youre screwed

And I guess you're one of those that think it's just about pointing that 2-ton vehicle down the road and hoping everyone else watches out for your dumbass moves and mistakes. Vehicles moving at speed have so much inerta that they can do serious damage to others when they collide......but then again, physics probably isn't a strong suit of yours.

I cannot believe people around here condone "I drove 135MPH last night.....ain't I cool!" or "I blew a red light because I didn't want to stress my car." kind of crap. I suppose everyone else is just less important than you, and your whole 1 year of driving experience makes you a soooooo much better driver than those with 20+ years of experience.

I suppose you follow these driving rules too:

You know how to cross 4 lanes of traffic in 5 seconds with no turn signals, because you believe using a turn signal gives away your plan to the enemy.

You think it's not actually tailgating unless your bumper is touching the car in front of you.

You know that a yellow light means at least 5 more cars can get through...and that a red light means 2 more can.

You've honked at someone because they didn't peel out the second the light turned green.

Stop signs mean slow down a little, but only if you feel like it.


Yeah, all those traffic rules are there just to inconvenience you....they have little relevance to safety, courtesy, or manners.

1. You admitted to speeding... at least you didn't get ticketed for that. 15mph later at night when the roads are more open isn't really hazardous to other drivers, so I won't give you grief over it.

2. You thought you'd make it through on yellow, but miscalculated.. It happens. I've done it, thought "oh sh!t", and looked around for a cop. Usually, if it's that close, you're not a real hazard to other drivers. So, again, I won't give you grief over it.

but,

3. You admitted to inadequate brakes. AFAIK, in New York, that's a misdemeanor offense. I don't know what it is in California, but I'll bet they don't ignore it. And, personally, I don't want asshats driving around who KNOW that their brakes aren't as good as they're supposed to be. So, take your car off the road until you get your brakes fixed. I don't want to end up injured or killed because some moron is driving around with bad brakes.

Pay your 300 and learn from the experience. .

USA, the land where no one is freaking responsible for whatever they're doing and just shift the blame to someone/something else.

All you need to do is fight it in court. Ask to see the "witness". There was no witness. They may claim that the camera is the witness. Okay, tell them to show you the camera in the courtroom. They won't, so you will get off.

Newsflash: Cars are built for emergency stops. As long as you don't go around doing brakestands in your car everytime you drive it, you're not putting any "strain" on your car that it can't easily handle.

And for all of you saying "he ran the light he should pay". The justice system in the US doesn't work like that. It has nothing to do with innocence or guilt, is has to do with what can be proved in court. If you kill someone but it can not be proved in court, you are innocent as far as US law is concerned. I don't agree with the system, but that is how it is and anyone who thinks otherwise is just kidding themselves.

Of course you couldn't stop in time, you were going "really fast". If you hadn't been speeding, you would have been able to stop easily and wouldn't have gotten a ticket.

So no, there's no way of getting out of this, pay your fine and next time, try not to speed.

They won't have to "produce" the camera.........the picture is the testimony in this case.......in many cases in this country, the "witness" does not have to physically be in court to give testimony.......a dying person's last declaration is just one example that comes to mind.
