He asks if I consent to a search, I said No. He says he smells weed and has probable cause. He searches my car and finds nothing, since I had nothing.

Does this sound screwy to anyone else?

The officer can do that. If he has probable cause your best off to just let him search (assuming nothing in the vehicle). Otherwise depending on state laws due to MADD/SADD communists the 'occifer' may have legal ability to search your vehicle.

OR, its based on his skin tone?

I got pulled over because the cop thought I had expired tags. I didn't but the license plate and stickers were so dirty that it was hard to tell from far away. The cop told me to get new (clean) tags and clean my license plate and sent me on my way. That was the only time I've been pulled over.

I'm white. I had stickers on my car. I had longish hair & out of state tags.
I know those are all crimes. He was right to pull me over.

In most states you can't get a ticket for less than 5 mph over the limit.

Chances are at 2am he was using the speed to pull a dui or narcotics possibility.

Looks like the "winners" and a "story" could be involved. Were they Highway Patrol/State Troopers? They are the least flexible.

. . . many years past, i was able to get away with "a lot" driving and was lucky [generally] with police officers (yep, even 80 in a 25 and "racing" another car to boot . . . but that's another story with almost unbelievable luck on my part that i didn't get a ticket or go to jail). . . then i got older [wiser] and slowed down.

been pulled over about 5 times on the highway, and always gotten warnings. Have gotten 3 tickets in ton though.

Once I blew past an Oklahoma trooper going 105 and he didn't even bother. Maybe he was asleep...

It just seems that if saying he smells weed is probable cause, they might as well not even ask for your consent.

Sounds more like a "bribe" and a "blowjob" was involved.

Cops normally care about a crack in a windshield about as much as any of us do. They only "care" if you (or arguably, they) are being a dick.

EDIT: On "speed details," AKA, speed traps, they don't normaly let anybody go. On routine patrol, they're a lot more likely to give you a warning--depends on the specific circumstances, of course.

I got pulled over this week by a Washington State Patrol. She said that I didn't use my blinker (which I did but I've always heard it better not to argue). She then quizzed me hard if I had been drinking. It was 11 am and I was in a suit on the way to a business meeting. She was very persistant, and she finally said that it must have been the hand sanitizer that was in my car. I only got a warning.

I have been stopped a few times, and Not gotten a ticket.

The last time was last fall,I went to a local bank, came out,
started to drive down a side street;that no longer goes all the way thru to the next
main street.
I had pulled about 30% of the way towards the street, and swung back onto the
main street, still headed north,to the next cross street.

I got to the side street,as the light turned green, and turned right.

I went east,to the next light,and as it turned yellow,hung a right.

At the next traffic light,it turned yellow, and a bus was stopped halfway in the intersection.
I went to go wround the bus,and looked in my rearview mirror to see a
State Trooper car, with the Lights on!!

I motioned to the Trooper, that I would go around the bus,and pulled to the curb,
and turned my truck Off.

I waited with the window down, and my hands on the wheel, when the Trooper got to me
I said,uh sorry about the yellow light,Sir.

He said ok,but what about the other yellow light, the Red light, and the darn U turn!!

 Huh,what U turn,and what Red light??

LOL<i told him,the darn side street got closed,in the last 20 years,and I didn't know it,
so i changed my mind, that must be what looked like a U turn.

He says, what are you kidding me,you really thought that street went thru to Broadway?
That street has been closed to thru traffic for as long as I have been a Trooper!:|

I say to the Trooper, well,I don't drive in downtown Albany much,in the last 10 years,
and the street did go thru for a long time,I am sorry.
I said you must not have grown up in this area, and I must be a bit older than you,
but,Sir,I am sorry,I did Not do a U turn.If you have to give me a ticket for the Yellow
light on Broadway,I deserve that.

He looks at my license, the inspection sticker, and the insurance card, and says to me,
go on your way,but watch the traffic lights. Then he says,I wish I had a video camera
in my car to watch the tape,I could have sworn you did a full U-turn!

I said,thank you Sir.Then drove home. :)

Hey, that what someone suggested about me - today. Absolute nonsense. :disgust:

i was just shocked to get away with "anything" from a CHP . . . in the past, in San Francisco, a city cop let me go for turning into a wrong way street . . . but they were well-known for being "nice" in the late '70s . . . the Marin County Sheriffs were notorious for letting polite people go . . .

i see that my case is not that Unusual.

Who is this to? i NEVER argue with a police officer . . . i may disagree - stating strongly my belief that i was NOT going 80 - but agreeing with him that i was over the speed limit (due to "circumstances" - cell phone, downhill, etc.) and promising to be more careful
( he is the regular patrol officer on "my" highway - i drive past him every day - you BET i will be careful).

i got pulled over by state patrol after picking up a mug shot of Randy Moss when he hit a traffic cop with his car. I was in my marked media car and the cop asked why I was going 20 mph over. told him I had to make a deadline and he asked what Moss did. I told him Moss hit a cop and the officer let me go. :)

I was once stopped on the NJ turnpike for going 1 mile below the speed limit. That is the reason the trooper gave for his stopping me.

For awhile I was getting stopped so often on the NJ turnpike that once after this trooper was following me for a couple of miles I pulled on to the shoulder. The cop crossed three lanes of traffic and pulled over onto the center medium. Drove in reverse and then crossed three lanes of traffic to get behind me. He jumped out of his car and ran to mine with his hand on his gun.

He angerly demanded that I tell him what the problem was. I told him that the cops were stopping me so often that I pull over whenever they follow me. He stared me for about 30 seconds and walked away.

Last time I was pulled, a couple of months ago, the trooper tried to get a lock on me, but couldn't quite make it. I spotted him coming up fast in the curb lane (three lane hwy), I was in the hammer. Started to back it down (from 90 in a 55). I got around the front car in the pack, signaled, brought it over into the center lane, started dropping it down thru the gears (didn't want to flash the brakes), kept the van behind me 2 sec. back. By now the trooper was on the right side of the van, looking to tuck in behind me. Heh, heh, he's gotta really jam it, which he did. By now I was dead on 55. 3 or 4 second pace and he hit the lights. Crap. Pulled to the curb, by the numbers (it was Sat. nite, late, and he was looking for drunks). Hands on the left, top of the steering wheel (don't want to make him any more nervous. Roll the window down. License and registration. Had to dig the wallet out. Never done this before, so I had to wait for his instructions. :) He checked my papers, did a walk around the vehicle, handed me my papers, and informed me that he had me clocked at 85 and anything over 80 is considered reckless driving. Yes sir. Now get out of here and keep it down a little bit. Yes sir. Thank you sir. Somebody's gotta give these young troopers a little high speed persuit practice. I think the grey beard helps a lot.

I was once pulled over for speeding and passing on a double-yellow, on a hill, on a narrow bridge. All at once. The cop (a county cop) told me he could take me to jail, since it was reckless driving. I apologized profusely, admitted I was an idiot for doing it, and he let me go. :D

County Cops can still be 'like that'. . . . a Sheriff in Marin County (way back when) explained that their job was to serve the residents of their county . . . part of that "service" was to get the goodwill of the regular citizens. He told me that he personally wouldn't give a speeding ticket unless the driver was a rude ass or driving otherwise dangerously . . . he figured a "warning" to slow down was just as good as a ticket.

i thought those days were gone forever . . .

(what did i know?)

[. . . i passed a Cadillac with a Deadhead sticker . . .
A little voice Inside my head said, "Don't look back. You can never look back."]

and then i looked back . . . red-flashing lights :p

:D
