i had the same thing happen, in fact i have had 3 bad experiences with fedex. they left the box in the bushes in front of my garage but luckily i found out the first night after i caleld and they said it was delivered. the reason i found it though was because they did this once before but the fedex guy went to my backyard and left it on the step to the backyard sliding glass door which we NEVER used and my mom found it 3 days later, it was a videocard, all was well though. and the 3rd i woke up to a loud BANG on the front foor. Thinking it was a loud knock i go to answer but nope it was the fedex guy, he frisbied my box from newegg from the sidewalk, about 20 yars from the door, when i opened the door he was getting back in hsi truck but he looked back waved at me and left, it was RAM in the box but all was well again. I wrote about it on anand at the time.

sure you can try and claim you never recieved it and it will work especially if you called to ask where the package was the first say they "delivered" it. Either the fedex guy won't remember your delivery anyway, or he won't want to tell them he left it in the bushes so he will claim he left it on your step or something. if you can ignore the ethical parts of this then go ahead.

If the HD is fine and you don't want to go through the hastle of lying for weeks until you either get your money back or another HD, then just run the HD as long as it works
