Guy pulls knife, i kill him w/my CCW. I get arrested because i didnt give warning?!

- I get into arguement w/a guy in movie theater lobby
- It escalates and he pulls knife on me
- Unfortunately for him, he just brought a knife to a gun fight
- i pull my licensed Glock19 and pop 3shots into his chest
- Cops arrest me 😱

apparently in VA you are suppose to give a warning before you are going to shoot?!
 
Maybe if you would use something with more balls than a 9mm you wouldn't have the problem of the guy living after you shoot him 3 times.
 
Wait... did that actually happen? If so... that's fucked up. Once someone pulls a knife and threatens you it's game on... even if he doesn't know he's playing.

In self defense I would be very surprised. Why does the number of shots matter if the target is still a threat?

BTW, you do NOT have to give warning if it is not practical to do so. The law may encourage it, but it is not a one size fits all stance. As a cop, I am told to give warning when practical, but if a crazy man comes at me with a knife, I draw and fire without shouting anything. Sorry, I am going home at the end of the day. And the courts have consistently backed this position up.
 
Yeah, if you shoot someone, even legally, you get arrested until the cops can confirm what happened. Thought that was common knowledge.

In any case, I seriously doubt this actually happened, and having lived in VA for most of my life and being a gun enthusiast I have never heard of a warning being a requirement in such an encounter. It looks good to a judge, but unless I'm blind it's nowhere to be found in the Virginia State Code. http://leg1.state.va.us/000/lst/LS102723.HTM

9mm is more than adequate. Not many would survive 3 to the chest of any caliber.

I took what little was given at face value. Also, the police need to establish probable cause for an arrest. Are there witnesses at the scene that are immediately able to verify the shooters version of events? Is the knife that was pulled on or near the body? How far was the shot taken? Those are the immediate questions that would come to mind.

Assuming that the "cliffs" version of these questions does indeed make it a clear case of self defense, no charges should be made. If the OP would like to update the post and at least provide more made-up details, it would clear up any questions that anyone might have.

However, lets get this out of the way right now to make sure we are on the same page and not talking about different terms. "Taken in for questioning" is not always under arrest. And being under arrest doesn't mean you can't be released without charges.

a 9mm is plenty, if you need a larger caliber then you're just a bad shot...
but if all the other guy had was a knife I honestly wouldn't need a gun.

even though this is an april fools thread I suspect people will be blinded by the subject of firearms and self-defense...

If it's true then I'm glad the OP is ok, but shame on you for having a CCW and not knowing the laws that apply to the use of his weapon.
