Basically, a student steals a gun from a neighbor, goes to school and shoots a teacher. Now the widow sues the school, the neighbor and the gun manufacturer.

Some of the more interesting snippits:

Pam Grunow's lawsuit accused Valor Corp of distributing a gun that was "unsafe, defective and lacked features that would have prevented a minor from using it."

Since when is it illegal for minors to use firearms? I learned to use firearms when I was about 7-8 years old.

The jury didn't find any liability for Nathanial Brazill, who pulled the trigger.

WTF? Believe it or not, inanimate objects, like firearms, do not get up and walk over and shoot a person by themselves!

I see this getting reversed in an appeal.

I find this abso-fvcking-lutely ridiculous, and I'm generally of the opinion that the US has way too many freaking guns. This is just silly though.

So let me get this straight: if I kill you with a gun then the maker is partly at fault? What if I kill you with a knife?

And what if I'm a brinks security guard and, thanks to using your gun, I get to protect an attempted robbery of $15 million. Well hell I guess I owe you some of that money, right? If not for your gun I could not have done it.

The law can't have double standards. Penalizing gun makers for this thing, and not rewarding them when their guns are used properly is silly. It's silly rewarding them and it's silly penalizing them. Nothing ever said that gun should be used in a crime.

Just retarded. In a country where most people have the legal right to carry a gun you cannot charge a gun maker if his gun is used in a crime, whereas 10,000 other people who have the same gun have done nothing but carry it around to protect themselves. Just so dumb.

On top of that, the school has to pay up $10.8 million. Ok, in case someone doesn't remember, this kid was sent home by the teacher for throwing water balloons. He went home (or to the house of the friend) and got the unloaded gun, loaded it (can you say intent??), went back to the school and gunned the teacher down in the hallway, killing him with a single bullet. This kid was an honor student. Things like this scare the crap out of me. My wife is a teacher in an alternative education program. Most of the students are good kids, but some of them are certainly not. A number of them have police records. There is one that got a three day vacation thanks to her just the other day. What scares me even more that the thought of something happening to her is the thought of what I'd do as a result. :disgust:

Exactly, the plaintiff failed materially to prove her case, but yet once again, this decision was 10% legal reasoning and 90% emotion, like most civil liability and tort awards. We feel sorry for your condition or situation, so you deserve something, whether or not the party against whom we will be awarding damages actually bears any responsibility for causing your condition. The award against the school board was even more absurd than the gun distributor, how in the hell was the school supposed to know or predict this kid's actions?

I see this getting reversed in an appeal.

Most likely, that is what has happed to virtually every other gun case of this nature. This decision was even more absurd and ripe for appeal, in that it is an impossible expectation to make a firearm which cannot be fired by a person dependent upon their age.
