Don't worry about it, they'll settle with your insurance company in short order and that will be the end of it. The lawyers are usually only in this for a quick and easy settlement.
 
WAIT aint this the accident where YOU were not paying attention to what was going in front of you and the guy stoped. then you rear ended him? i was looking for the orginal thread to be sure but can't seem to find it.

the accident was your fault. you are going to lose. Even if it was a setup you still are the casue of the accident.
 
If someone sues for injury claims, do they have to prove their medical bills?

Is there any way for them to profit, by not getting the actual medical service?

Lets say you are seriously injured in car accident when a Dr. Pepper truck broadsides you. You have $250,000 in actual medical bills your health insurance company pays the majority of. Lets say your non insured portion is $20,000 and you dont have PIP on your auto policy.

You sue Dr Pepper and win a judgement of $200,000 total. The lawyer walks away with $60,000 leaving you $140,000. But now, here comes your insurance company wanting to subrogate their costs against your award. Guess what? Not only might you lose every penny of what you have left, but in the end you'll have nothing for pain, suffering or worse...ongoing medical care.

United Healthcare is the worst when it comes to subrogation. I read a sad story about this in the WSJ. Theyre argument is that you shouldnt be paid twice. That makes no sense to me since THEY are in the insurance business and THEY take the risk of paying a claim based on you and your lifestyle / existing conditions. If THEY lose money because of claims then thats the risk THEY took to collect your premiums. INSTEAD now they are taking your award away to cover their business risk IMO. Thats not right.

Pulled up behind a dude who had a clear shot...he went. I get up, stop look for oncoming, still clear...go. Maybe make it 10 feet to find him stopped in the traffic lane with no reason. He just slammed his brakes.

Anyway the impact was more pushing than a hit. I was maybe up to 20mph if I was lucky. He was already on the phone and kept calling people. I had to walk up to ask him to pull forward so I could get out of oncoming traffic.

He just kept calling. Three different police (two border cities and the state), about 6 emt/fire rescue/ambulances. I just had a bad feeling.

He insisted he was in major pain, his daughter? was worried she was going to be late to something...his wife was asking weird questions/etc like when I was trying to get my car drivable "wouldn't it be better to leave it damaged?" just a bad feeling i got.

I get home and look up on our county's court system.

Guy is 67 years old...has a felony drug conviction, eviction, charges of beating his wife (with both listed as indigent), he is on a payment plan for a criminal traffic infraction as of last month (which was $400, he has to pay $30 per month). About 5 other traffic infractions over the last few years.

His wife has interesting stuff too?being sued by capital one, sued by providian, also beaten by her previous guy who she tried to have baker acted, also has evictions.

This is probably going to be a mess.

My car is messed up...with a radiator it would be fine to drive probably (I made it about a mile driving home with it). There car probably could use a new exhaust and rear bumper cover...my car is so low it didn't hit the major parts of the car so much, but it just sort of acted like a ram against the soft sheet metal of my car mangling it.

I am thinking they maybe looking at me as a lawsuit out of trouble.
