As a former employee of an Personal Injury law firm, I can tell you for a fact that 80% of our cases are like the OPs in that phantom injuries are turned into thousands if not tens of thousands of dollars in settlements. Unfortunately, if a so-called victim requests an ambulance, there's protocol that the EMS and ER have to follow. It's almost always neck pain which requires a neck board/brace until x-rays can determine that there weren't any broken vertebrae. 99.9% of the time, the diagnosis is whiplash and you're given some ibuprofen and sent on your way. fancy medical terms like contusions(bruises) and lacerations (cuts) are thrown around to make the so-called victims worse than they really are. The people who pull this stunt almost always have no insurance so you're almost always stuck with the bill. Even if they do have insurance, the size of the bill will be used in the demand packages to your insurance company to underscore the severity of their injuries. If there were additional medical expenses associated not from the ER, those doctors (sorry, i meant chiropractors) are almost always associates of the law firm and artificially inflate their prices. they will never get the amount of money they're charging because they just get a cut of the settlement money.
Unfortunately for us law-abiding citizens, it is almost always cheaper for your insurance company to settle with the firms than to litigate. It doesn't matter to them, they'll just recoup the settlement money by raising your rates. If the medical bills are in the 100K range per person, the insurance companies adjuster will probably negotiate it down to 30k-50k per person and get it over with.
OP, I feel for you because the main reason I left my job was because I was literally lying though my teeth negotiating with insurance adjusters. They know our client's full of shit, we know they are yet we still play this cat and mouse game with both sides threatening to take the case to court while both sides know that taking the case to court is the last thing we want to do. It's comical in how sad the whole ordeal is. In the end, the people who suffer the most are us.
I was rear-ended once by a car going at least 15 mph and I know from personal experience that even at that speed, my neck was sore for like a day and the so-called injuries went away within 24-48 hours, no medical care was required. I could have filed a bodily injury claim against his insurance and after months of physical therapy, I could have gotten 5k in settlement money but I didn't want to go through all the trouble of dr. visits for phantom injuries and i couldn't do it with a clean conscience. Even though my boss kept telling me to file a claim (he said he'll give me 70% of the settlement).
I guess the point of this post is encourage everyone here who undoubtedly know people who have been in car accidents. Put yourself in the other drivers' shoes, would you want them to sue you with phantom injuries if you were responsible for the crash? No person in their right mind would intentionally try to hit you with their car. It's as much trouble for them as it is for you. While i'm on the topic, after a crash, don't get out of your car and start making profanity laden accusations at the other driver when you were at fault. This sort of defense mechanism will only make me want to file that phantom bodily injuriy claim to spite you. Just be cordial without admitting fault one way or the other. The police will sort through the statements and property damage, skid marks, etc. to determine who was at fault. The bottom line is that while you may earn some extra cash going through with the farce, everyone else, including you, end up getting the shaft with higher insurance rates all around. If you have legitimate injuries, by all means get the needed medical attention but a sore neck for a day or two does not require thousands of dollars in X-rays and doctors visits. It's called advil and its in your medicine cabinet. take a couple and you're good as new.
