I didn't realize that. Around here, there are two charges; DWI - driving while intoxicated, and DUI - driving under the influence. DUI is the lesser offense.
DWI is > .08%
DUI is < .08%, but ability impaired.
People with more than 1 DUI should be beaten with a tire iron before being allowed to leave the jail. Maybe brute force can beat into them what being arrested cannot.
I just lost an uncle friday and my aunt was also in the car and probably will die as well because some drunk 26 yr old ran a stop sign he said he didn't see.
MF should be dragged behind the car through the crossing from the way he approached it.

Is it possible in any way to avoid a DUI by sleeping in your car and throwing your keys someplace not by the drivers seat? Maybe pass out in the back seat or passenger seat? Or, is it as I have heard, that the keys need to be outside of the vehicle if you are going to purposefully pass out inside the vehicle after drinking?
Your parents must be so proud of the fine human being you have become. Truly, you are disgusting, and should be locked away with the key thrown out to prevent you from killing and/or injuring someone. Obviously this is the fourth time you have been caught, but not the fourth time you have been this stupid.

Can that have the same impacts in a person's life as the, in this case, DWI, can have?
There are legal limits for a reason. Being able to get charged when your following legal limits, thus following the law, seems wrong... especially when the "ability is impaired" concept can easily range from cop to cop, with some pushing the "if you had 2 drinks, you're impaired" bullshit angle.

Around here, if you paid attention, you'd get 3-4 per night.

The "ability is impaired" concept is determined from standardized field sobriety tests, the three most common of which are used nationwide. Under NH law, impairment "to any degree" constitutes DUI. If you're over an 0.08, you're considered automatically in violation regardless of impairment.
Engine wasn't running, but the ignition was on. Under 21, too. Parked on the side of the road in a no parking zone.
jlee, is it an absolute no-no for someone to pass you when you're already doing the limit? Is that an automatic pull-over?
PSA: If you're so drunk that you pass out before you're able to pull out of your parking spot, you should have called a taxi.
