I'm always interested in that.

Thankfully, most times I encounter cops on the road, they are either going above or below the speed limit, not at the limit. So either I let them pass me (or get way ahead of me), or they are going 5mph under and I can pass them and slowly, ever so slowly, build up the distance between them and I, and eventually get to a distance where I can push the accelerator a little more. :)

jlee - another question regarding DUIs, specifically relating to this type of arrest.

Is it possible in any way to avoid a DUI by sleeping in your car and throwing your keys someplace not by the drivers seat? Maybe pass out in the back seat or passenger seat? Or, is it as I have heard, that the keys need to be outside of the vehicle if you are going to purposefully pass out inside the vehicle after drinking?

My understanding:
It's called "Actual Physical Control". So, if you have access to the keys, you get arrested.
Best to hide the keys (it was suggested to me to place them under the tire then let the car coast over them/hide them under a rock) and then when the cop asks where they are, lie. Say a friend has them/lost them/etc. But, hopefully you aren't so drunk that in the morning you forget what you did with them.
You are also likely to get arrested for drunk in public or some such similar charge if they find you drunk.

any charge that's not DUI is likely better than DUI. It's a worthwhile last ditch effort to escape possibly getting a DUI, and if I ever find myself without a ride and I had driven there but let myself get drunk.. I'll probably take that route. I cannot afford a DUI because that's means Army Commission = bye bye, and while a Drunk in Public charge will likely see something fun from higher ups come down on me, it'd be better than getting stripped of Commission.

I don't think there is much legal difference between the two. Just different terminology though I do think DWI is a better term. You could just be ass tired and you are driving, that means you are DWI.

Unless DrPizza there is actually 2 different charges in your area? If so do elaborate.
I didn't realize that. Around here, there are two charges; DWI - driving while intoxicated, and DUI - driving under the influence. DUI is the lesser offense.
DWI is > .08%
DUI is < .08%, but ability impaired.

There are legal limits for a reason. Being able to get charged when your following legal limits, thus following the law, seems wrong... especially when the "ability is impaired" concept can easily range from cop to cop, with some pushing the "if you had 2 drinks, you're impaired" bullshit angle.

It's pretty simple actually. Not everyone can operate a vehicle after having a couple drinks. Some people just can't hold their liquor. Everyone has seen that person that is fall down drunk after two beers. If an officer pulls you over and deems that you are not able to operate the vehicle safetly they have the responsibility to get you off the road. Say you blew a .05 but shouldn't be driving and they let you go. You drive two miles down the road and take out a family of five. Who do you think is going to get sued? Don't drink and drive folks, not a difficult concept. Personally I think the limit should be .02.

I don't think that I've ever seen a cop doing the limit. They are either stopped, or speeding.

Which suits me just fine.

People with more than 1 DUI should be beaten with a tire iron before being allowed to leave the jail. Maybe brute force can beat into them what being arrested cannot.

I just lost an uncle friday and my aunt was also in the car and probably will die as well because some drunk 26 yr old ran a stop sign he said he didn't see.

MF should be dragged behind the car through the crossing from the way he approached it.
