Got into a accident

so im riding southbound on state round 7 in the middle lane, driving along and all the sudden this guy in a beater (early 90''s sentra 7 different colors on the car, no right side mirror and a cracked windshield) side swiped me. now i need a new fender bumper and drivers side door, the worst of it all i got pulled away in an ambulance for severe neck pain on my lower neck and upper back shoulder area. this really sucks my insurance deductable is $1000 and im just a broke student, worst of all their were no witnessis and it was he said she said and nobody got a ticket, so its on my insurance.

Does that degenerate even have insurance? Cracked windshield should be a no cost replacement in FL.

So you guys were the only two on the road and he just came up besides (in the left? lane) and rammed you?

First, I'm not trying to rag on you, but society in general needs to stop referring to car wrecks as accidents. You weren't accidently in a wreck, the guy was negligent by not paying attention to where he was driving and he sideswiped your car and injured you.

Second, get yoursefl a lawyer and have the lawyer pursue this against the driver/driver's insurance. It doesn't matter that the officer didn't assign fault. It would seem that since no one was ticketed, he had to have had liability insurance (Not sure what state you are in but most states require liability insurance).

Third, I know it is too late to do anything about it now, but if you can't afford a $1,000 deductable, you shouldn't have this limitation on your insurance. Yes, I know it costs more in premiums, but you are paying it out over time.

Sorry about your accident but I'd like to hear what the police have to say in their report first. Given that you're a 17 or 18 years old in a tC, I would probably want to hear the other side of the story. Amazing that there weren't any witnesses too.

aside from not speaking english the guy had no ride sight mirror and a crack windshield but no ticket. its not like he cares though his car was an early 90s sentra with about 7 different colored parts on it

So what you're saying is that the guy got no ticket and you were the one at fault (according to the police)?

no i got no ticket, its all she said he said anf the ins is onna fight it out, the the meantime i gotta take 1000 out of the bank and get my csr.

Yeah, I've never heard of anyone just side-swiping another car on an empty highway for no reason, especially with no ticket given. If they literally came up and hit your car for no apparent reason, I'd be talking to a lawyer and trying to get criminal charges (assault / assault with a deadly weapon?) put over their head, especially considering you got hurt.

On the other hand, if you were racing or instigated the situation in any way (giving them the finger, revving your engine, cutting them off, failure to stay in your own lane or merge lanes properly when required), it would be a different story.

Sentra driver was probably distracted and drifted out of his lane. Happens.

I see it every day.

Also, people change lanes for no reason sometimes, and there are plenty of people who don't look before they change lanes. It's amazing that most of us get where we're going alive every day, to be honest. It's the biggest single example of trust we have in modern day society that we allow ourselves to get on the road with all these strangers.

im doing better then before, my neck is still sore and tense but my overall pain level is lower. thanks for asking.

Dude you are a fucking asshole.

If humans were 100% perfect there would be no accidents of any sort at all.

The whole accident / wreck thing is about as played out as the parking/emergency brake deal.

Now if someone is driving down the road carmageddon style then the 'wreck' deal is more appropo.

How did you end up getting back/neck pain if you were side swiped? Did it spin you out, or did he ram you pretty hard?

This story still doesn't pass the smell test, so were you passing him in the center lane, or was he passing you and just decided to merge over...again with no other traffic around?
