in what state is it legal to throw a dependent minor out of the house?

don't strain yourself with such inquiries. Look into the OP's profile. he has a thread in which he says he's 19. now he's magically 16. He supposedly smoked a shitload of weed and his mother is obsessed with him. All this is his sick idea of a fairy tale.

Puq, you should post the citation's section/part reference and quote the specific law from that website. It might help the conversation and might get other people's opinions on who the "occupier" qualifies as.

I mean, shit, you should have said right there "I'm an occupier too and I give you police officers the right to kick my parents out of this house. I don't want them here, get them out!" :p

I'm glad you're not my kid. You sound like a real fvcking piece of work. I can only imagine what a little sh*t you were refusing the cops. They should have beaten the attitude right out of you on your front lawn. Better them than somebody in juvie later on who's just as much a fvck up as you are and won't stop until he's tired.

It's not black and white. "Doing drugs" as a blanket statement includes sugar and caffeine. As an example, too much caffeine can kill you by heart attack.

I'm not advocating narcotics, but a little weed isn't going to do any damage, itself. It's the personality type and other habbits in life that will screw him up.

that makes no sense. is water a drug because you can die by drinking too much of it?

Drugs are those substances that appear on the federal controlled substance list. And the effects of marijuana are irrelevant. The point is that the parents rules should be respected. I remember coming home on weekends from college and not drinking at home because my parents didn't like it. Nothing to do with the legality but rather respect.

Playing devil's advocate, I use the number pad when entering numbers. I hate using the number keys above the qwerty. That being said, 6 and 9 are right next to each other and easy to typo and not notice.

something smells fishy - you're a minor, so your parents can't really kick you out for 2 years. I call bullshit.

Emancipation doesn't work that way either - you have to be the one that declares youself emancipated / independent of your parents.

A drug is not defined by it's ability to kill you.

There needs to be an IQ requirement for forum registration...

its trespassing not a moving violation. it doesn't matter if the cop shows or not.

no, in the United States it's defined by whatever the feds put on their nice little list.

There really should be an IQ requirement for forum registration...

It appears, according to child welfare, there are 5 Provinces (plus 2 Territories) where anyone 16 or older is not considered for abandonment. So if he is in one of those places he could be S.O.L.

Otherwise he may have a case for abandonment:

The caregiver:
  • shows a lack of concern for the child or takes a dismissive approach to the child's problems;
  • uses, or asks caretakers to use, harsh punishment if the child misbehaves;
  • sees the child as worthless, entirely bad, or burdensome;
  • has inappropriate expectations in relation to the developmental stage of the child; or
  • looks primarily to the child for care, attention, and satisfaction of emotional needs.

Hard to say though. Can't you just talk to your parents or is too far past that now?

Actually, you're wrong. Caffeine IS a drug and it's not on a controlled substance list. Sugar is the same.

Are you intentionally being stupid? :hmm:

Clearly, I'm talking about a criminal context.

And no need for the personal attacks.

lol that's kinda bad to be kicked out from entering your house at 16, not like you could afford to live on your own... but I wont take sides, maybe you had it coming? I'm curious to hear the other side.

As for paying, I would just pay it. WAY easier then having to go to court. Lawyer fees alone will make it not worth going to court, and without a lawyer you have very little chance.
