in that case he can just go to court and point that out. Due to margin of error, he could have been infact going the speed limit (unless he was doing the speed limit in bad wheather). Ofcourse, any judge that lets someone get ticketed for doing 1 mile of the speed limit....man.....

He said he was stopped, not ticketed. I could technically stop for it also.

The ISP around here are a funny bunch. Some will give you 15 over and others will give 5 over.

You were speeding, you got a ticket. 8 over may not seem like a lot but different regions have different standards. I can drive 20 over the limit in the Twin Cities without getting a ticket, but if I drive even 10 over in ND I'm certain to get a ticket.

Just pay the ticket, it's not worth the hassle. Remember to include a stamped self addressed envelope so they will send you a receipt. IN has a reciprocal agreement with all other States about suspending your license and most Counties will notify BMV if you fail to pay to have your license suspended. As SunnyD said the points may not transfer but I wouldn't count on it. I know out of State points transfer to IN. As far as taking a DDC save the $40 bucks, it's not going to get you your points back. In Indiana DDC is used after your license is suspended, then you have to take the course before you get them back, ( along with an SR 50, SR 22, reinstatement fees, the promise of naming your first born son Mitch, and kissing the double chinned, harry mole, 400 lb BMV lady right on the lips) .

Unfortunately, because you're in GA, you didn't see all the news stories about the cops cracking down on Labor day weekend watching for speeders and drunks with instruction to give no quarter! Hey, we need the money, the States going broke!

Yeah, but the fine is the same for 15 over. Passing isn't relevant, the speed limit is the same when you're passing.

If anyone hasn't noticed, I'm not contesting the fact I deserved the ticket, and I am willing to pay the fine, but I don't think I deserved the points and the future problems it brings for the single strike in my 6 years of driving in the law and I want to come out of this best I can.

GA is not a compact state. That said, Indiana is - they will send the record to GA. Whether GA will or won't do anything about it is up in the air though. That being said, my wife having received tickets in FL with a NY license (both compact states) had no points assessed on her license.

Again, it all depends on the state, or even the county. Talk to you local DMV.

Yes, it is. Discretion is a critical piece to the 'puzzle', if you will. Are you telling me I should have written the cardiologist who was en route to the hospital after receiving an emergency page? Middle of the night, nobody on the road but me and him, and while he was exceeding the posted speed limit, his speed was not necessarily unreasonable or imprudent for the existing conditions - and per New Hampshire's speed statute, a judge could easily throw it out (I would).

I called them this morning. My ticket still hasn't been processed and they told me I would indeed have to talk with the local DMV for points removal. Said it will probably be another week before the ticket is processed.
