Got a Ticket :(

I was driving to the Local post office. (I go there many times....on average, 2 times a week, so I am very familar with the area).

It was raining. My headlights were on and so were the taillights (new CA law) Speed Limit is 40mph and I was driving at 30mph (30mph is what it states on the ticket).

I cross the suppossed crosswalk where acc. to the cop, there was a Pedestrain. I never saw anyone on the crosswalk. I saw a cop pulled up behind me but wasnt worried since the Police station is right next to the post office on my way and I thought he was just going to the station. I drive forward about another block on my way to the post office, took a right at the intersection (it was a green light). Drove another half block, stopped at the stop sign and turned left. And now the cop gives me lights and pulls me over (right between the Police station and the Post Office). (he gives me the lights after following me for about 2 minutes)

He told me I failed to yield to a pedestrian who was wearing a yellow jacket. I said that I saw no one there. He took my DL and registration and came back with a ticket. I said "thanks" and went to the post office.

Came back from the post office and was driving back. And this time I saw that pedestrian wearing the yellow jacket standing on the sidewalk (this was 20 minutes later).

Also, I saw another cop giving ticket to some other person 1 block down the road on the way back. Also, there was another cop car in the street on the side right next to the crosswalk waiting for another one failing to yield.

There are no signals on this crosswalk. The crosswalk is right next to a gas station and there is a fire station about 200 ft from the crosswalk. I consider myself a safe driver and honestly, I never saw anyone on the crosswalk.

I think that it was a setup by the cops. what I failed to understand is why did the cop who gave me the ticket followed me for ~2 min before pulling me over.

I am thinking of contesting this ticket.

EDIT:
Also, the cop made a mistake on my ticket. He wrote down the model year as a 03 while my car is a 1996 maxima. Weird that he didnt even copy it down correctly from my registration.

This address if of the Gas station just moments from the intersection.

The crosswalk is at "W 2nd St" and "Military West" junction (No traffic lights).
The cop pulls me on the "E L St" just before "E 3rd St"

It is a setup.

It's common for cops to setup a sting when they receive complaints from people in the area that people do not yield to pedestrians. The person you saw in the yellow jacket is more than likely an officer.

I'd definitely document (write down) what you saw so you don't forget. THen I'd call the DAs office and let them know what you saw them doing. Entrapment is illegal and if the person wasn't crossing the street but was jsut standing there so the cops could ticket people, that's entrapment.

I recommend ALWAYS contesting the ticket. In some jurisdictions, if the officer fails to show, you walk out freely. It's worth a shot....

It does sound like you were setup, though.

You need to look up what entrapment really is.

Hint: It involves coercing the suspect into committing a crime they wouldn't normally commit.

And this is what gives cops a bad rap.

I'll add my own story about an asshole cop. A couple weeks ago I was walking to the gym in the afternoon. A cop had a stakeout on an intersection to give jaywalking tickets (giving $75 jaywalking tickets is the new revenue generating fad around campus). I watched a guy cross the intersection on a green and yet get a jaywalking ticket. The little walk/don't walk thing was flashing don't walk. It wasn't even solid. And at that intersection the "don't walk" sign flashes for a good 30 seconds before the light changes. It's crazy long.

Traditionally, cops will only setup a sting like this when they receive numerous complaints from the local citizens of people not yeilding to pedestrians, or if there have been accidents in the area.

Writing traffic tickets on the highway is much easier and much more profitable from a revenue generating aspect.

Try and watch the "sting" in action. If the pedestrian just stands there and gives no indication of crossing, that is bull crap.

Who would've thought that standing at a crosswalk didn't give indication that they wanted to cross...

updated with map of the area :( I am little annoyed. It was definately a "sting" operation otherwise who would just stand out there in the open in the rain for 20 min ? I saw the pedestrian in a yellow jacket there 20 min later when returning from the post office.

The time on my ticket is 1:20pm and I was returning from the post office at around 1:40pm. I got the ticket at 1:28pm from the officer.

Same here. The cops absolutely love handing out tickets to people that don't yield to pedestrians. Ironically, the only person to ever come close to hitting me was a local police officer driving in an SUV.

The cop followed you for 2 minutes and several blocks so that you were far away from the sting and not give warning to other unsuspecting drivers to slow down.

EDIT - they usually have a camera set up somewhere to document that the person was on the crosswalk at the time you drove by.

In the state of Florida, when there are no signals on a crosswalk you must yield to pedestrians that are IN the crosswalk. You do not have to yield to pedestrians that are on the sidewalk.

LOL easy there Atticus, that is not entrapment. Wikipedia does a pretty good job of explaining it.

We had the same sting here. But it was announced in the local paper the day before as a make people aware of the new Oregon law thing. But if you were out of town the day before or didn't feel like paying $0.50 for six pages of news and a dozen pages of ads, then you were SOL. A cop was the bait crossing at a four way stop over and over. If you drove over the line before both of his feet were on the opposite sidewalk he would then radio a police car waiting two blocks away to ticket you. The law says the person must clear your lane by six feet, but they were ticketing for going at all until the sidewalk was reached.

This is a big problem downtown where the drunks are out in the afternoon and take a light and a half to cross an intersection. I was waiting for a drunk to cross so I could turn right for half a minute, he just crossed the double yellow and decided to turnaround and head back to the bar. "Aw come on!" Darwin?s law should have precedents some times.

You're right, entrapment is illegal. Good thing it's not even close to applicable here.

Same here. The cops absolutely love handing out tickets to people that don't yield to pedestrians. Ironically, the only person to ever come close to hitting me was a local police officer driving in an SUV.


it is just a regular ticket (just like you would get for speeding except it says "Ped in Crosswalk and the section number".

I should receive the actual ticket with the fine and bail amount in the mail in couple of weeks. It is an infraction offense.
