God dammit. They towed my car and gave me a DUI

Sorry man, it's strange nowdays, back in the day driving after drinking was nearly an olympic sport...

I remember driving many a time with one eye closed so I wouldn't see double.

Now 1 drink is my limit.

I remember those days. Blasting down a minimum maintenance country road that looked like it was a 4 lane highway I was so messed up.

OP,

Get a lawyer as soon as possible!

What for? Spend a couple grand, but you're gonna get convicted anyway. Numbers don't lie, as far as the court is concerned.
Go to court, take your punishment, pay your fine.
See...3 easy steps. 😉
1. Go to court
2. Take your punishment
3. pay your fine

OP

Get a lawyer, the best you can afford.

Well, it might have been faulty equipment. I hope it was.

Ultimately it doesnt matter. i walked so...

Long story short, I was 17 out partying. I was last guy to show up, so my car was positioned first to leave (Small driveway getting it).
Guy gave me a beer, I was about half done with it when everyone decide to go. Fair nuff. I got in my car, drank almost the rest of the beer, threw the can out the window and pulled forward. I went about 5 feet before a car came around the corner in front of me. It was the cop. Yay.

So, there was literally less then 5 minutes before I tok a nice big swallow of beer and blew in that meter.
Net result? .29. Oh yeah.

not only drinking and driving...but doing it underage...
wow...you must be a complete moron.
Laws were made to protect you and the people around you. learn to follow them or move to antarctica.

I know! I mean damn, I'm probably the only kid in all of America to drink underage!

If you lived in Virginia I would tell you to get a lawyer that can schedule you with this judge.

Judge Ian M. O'Flaherty made it known in July that he felt Virginia's DWI law unfairly deprived defendants of the presumption of innocence if breath tests showed that they had a blood alcohol content of .08 or higher, levels at which people are presumed to be intoxicated.

78 in a 55 (I rounded up when i told him i thought i was doing 80)

anyways, nothing wrong with going 80 in a 55, under proper conditions.
and why the personal attack all of a sudden by calling me a dumbass?, that was unnecessary.

78 in 55 is Reckless Driving where I live (VA) , you are lucky that you didn't spend the night in jail or lose your license for 6 months.

It doesnt matter how drunk you are, so long as you do your drunk driving during the unwritten but commonly acknowledged times to drive drunk. Personally, I think it should be allowed, but it isnt.

what about the people who have jobs at night and need to transport themselves to their job locations? Or truckers on the road at night? Or other people who want to use the roads at night for various reasons?

The hours of midnight to 4 AM are reserved for drunk drivers. You know this. I know this. Everyone knows this. Between midnight and 4 theres 2 kinds of people on the roads. Drunk drivers, and cops looking to bust drunk drivers. Why dont we just let midnight to 4 be a "free for all" as it were, and as long as you keep the rubber side down and keep it on the road your good to go.

As for those with night jobs...Name 1 night job anywhere that does shift change between midnight and 4.

I wasn't aware of this general consensus.

Sorry, but there's no excuse for driving drunk at anytime. You not only endanger your own life, but the innocent lives of others.

There are lots of people on the roads here between the hours of 00:00 and 04:00. Twenty-four hour gyms, Wal-mart, and closing restaurants are the main sources.

I think you got off easy. I'm assuming it's your first. Wise up and don't do it again. I know someone who claimed to have only had "drank 2 beers" before he hit a woman crossing the street. When they tested him, he was at .11 and also had some percocet in him. Instead of taking the plea bargain offered, 2 years in prison, he stupidly went to trial and got TEN years.
Oh, I forgot to mention, she was getting married the next morning.

He served every day of that ten years, is on prob for 5 more, and lost his license forever.

It was his first DUI. He learned the hard way.

Wise up. Drink at home, or get someone to drive you.

Ah, but you see the Supreme Court has already ruled that the Constitution doesn't apply to drunk drivers when it comes to the burden of proof. Don't have the link handy, but it's true. Kinda scary when you think about that.

Not really, all the proof the cops should need is that .08 or better. If you hit it, you lose.

If I had my way, the second time you get DUI'ed, you would get a year in jail, minimum, and forfeit your car, since obviously, you can't control yourself.

Even as a goof, this is really stupid.

This is coming from someone who occasionally drives between 2-4AM, and doesn't need any assclowns driving drunk.

Lock them up, take their car, screw 'em. I have no sympathy for drunk drivers. I don't understand how someone of seemingly normal intelligence can be so stupid as to do it.

it is not as easy as that. Many business owners rely on ppl going out and having drinks. The economy would come to a grinding halt if ppl stopped going out for drinks. The problem now days is there are more cars on the road than ever. Instead of telling ppl to say home which is entirely unrealistic, perhaps an additional tax should be placed on booze sales to fund free or subsidized drunk cabs/vans. Especially in rural states like CT where its ten miles to the nearest downtown area having a van or cab take me home for a couple bucks would be amazing as opposed to the nearly 30 that it would cost me otherwise.

I had 2 beers

That's what they all say, to which I generally reply "how big were those beers?"

Wait, he's not done. He's just starting his list.

- 2 beers
- shot of whiskey
- shot of tequila
- 3 belgian wheat ales

ALl you have to do is limit your drinking to 1 an hour and you are fine. When I said stay home, I meant if you are planning on getting hammered, then stay home, or get someone to drive your drunk ass around. I know someone that has the people who work for him take him home when he's been partying.

I don't know how old you are, but around here, there are a lot LESS drunk drivers than there used to be. I live and work in an area with a lot of bars in it, and I used to see cars weaving, slamming on brakes for no reason, etc all the time. Not so much anymore. When I lived in Las Vegas, the amount of drunk drivers was just out of control.

I did the right thing around Halloween and called 911 on some moron driving really badly on a local freeway. He was already suspended for his last DUI, and blew .22. He claimed he only had "a couple of beers".

Drunk driving is really not something that can be defended, it's just stupid.

I can understand your points but you are overlooking a few glaring holes. It isn't about being drunk when you drive these days. Its only about what you blow. Blowing a .08 is rediculously easy. Even following your 1 drink per hour method. You only remove .4 drinks per hour from your system. so 4 drinks in 4 hours can still leave you blowing a .08. And on top of that the way the law is written you dont have to be a .08 to be arrested. That is just the cutoff. You can be charged with driving while intoxicated at .06! I am all for responsibility but these days if you have any drinks you should not be behind the wheel of a car cuz you can and will get arrested for DUI and if you haven't been caught yet its just a numbers game. You may never get caught but then again you may get nabbed the next time. Also often times many ppl dont go out planning on getting hammered.....but they do anyways. If you go out and you end up drinking you should be able to get home safely wouldnt you agree? Making safe transportation available for reasonable rates would eliminate this whole issue almost entirely.

Alcoholism is a disease. Would you blame someone with a lung disease that required them to carry an oxygen bottle around with them? How about a cancer patient with no hair, is it their fault they have no hair?
Same thing. Its not an alcoholicsfault he drives drunk, its his disease..........

Eh, you'd be hard pressed to find ANYONE doing less than 75 in a 55 on the LIE or any long island highway. 80 in a 55 isnt that bad when you realize you need to do 70 just to keep up with traffic.
