i'm pretty sure in any state a left turn must yield to on coming.
 
Doesn't it depend on whether the guy going straight through had adequate warning that the light was about to turn? If she had claimed the intersection, then the yellow is her time to turn. Of course, she still should have been watching.

If you are already in the intersection when the light turns red it is legal.

Furthermore, there is no question she is responsible on her part. Even if the light was a green turn arrow she technically SHOULD get a ticket, however that doesn't leave the other guy without any blame for running a red light.

If the light was red he would get a ticket for running a red light and she would get one for failure to yield. Let the insurance battle out the other part.

Your gf is at fault since cars turning left need to yield to cars going straight.
 
Was the light yellow for both of them, or was it turning yellow for the guy going straight as it was about to turn into a green arrow for your GF? That might impact the decision.

If it was yellow for both, then I'd imagine it's going to be largely her fault. Even if it was about to turn green for her, though, I'd still the majority of fault would lie with her.

ever drive in downtown L.A.?
where the traffic is horrible and there are no left turn traffic signals. The ONLY way you will make a left is on yellow. Try and see for yourself. If you try to floor it on yellow, the cars trying to make a left will honk like crazy.

I have seen this go both ways, depends on the timing.
 
I think unless she has a witness at the scene, traveling in the same direction as the guy, she is screwed.

She doesn't know what his light was doing, or when it was doing it. She is assuming his actions and or circumstances, which most certainly won't be a viable defense.

California law says she's at fault. Vehicle traveling through the intersection straight has the right of way, and your GF had the greater duty to yield. Since she was proximate cause of the accident, she'll be 100% at fault.

She's 100% at fault because the driver making a non-protected left turn has to yield to oncoming traffic (even if that traffic is trying to beat a yellow).

(a) The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.

(b) A driver having yielded as prescribed in subdivision (a), and having given a signal when and as required by this code, may turn left or complete a U-turn, and the drivers of vehicles approaching the intersection or the entrance to the property or alley from the opposite direction shall yield the right-of-way to the turning vehicle."
