Patents are there for a reason, to ensure innovation. There's NO doubt Apple has been innovating software and hardware.

If you sit on your fat ass and wait for someone else come up with better way to do things- sometimes you lose out.
To the ambitious go the spoils- Apple deserves this success and to stop patent infringement, which has been decided by the courts as correct, and valid.

Tears over this reality need to go elsewhere, like into hard work to buy an Apple device- if you want their functionality. Just speaking the truth.

Apple simply filed first, and is claiming it as their invention - it is NOT an actual innovation though.

If you can't see that Apple is hurting technological innovation in this country, maybe you should look at how other countries are willing to throw out their claims because of how ridiculous they are

Judgment already happened, no point in linking to various patents becuse I am sure Samsung/Googles legal team already tried it.

It's a preliminary injunction - Google is doing this just to keep selling the phones. The actual final decision hasn't been made on who is actually infringing - just that there is reason to believe a ban should be in place. BIG difference

In fact, they were just granted a respite by the judge, meaning they can sell the original phones again for a few more days

I've seen this argument a lot. As if the reason people don't get iPhones is purely because they can't afford them....

It is pretty amazing the delusions some labor under, isn't it? I guess whatever distorted reality it takes to make some people feel better about whatever they have.

The whole "you can't afford it" thing is such a silly delusion when it comes to phones.

The cheapest subsidized iPhone is $99 on Verizon. (Don't know about other plans, but it's probably similar). The 16GB 4S is only $199; $50 cheaper than the flagship SGS3, and right in line with most other decent smartphones.

The iPhone is so 'exclusive' that I see people's five year olds with them. Only in fantasy-land does that situation still qualify something as 'exclusive'.

If they're allowed the patent for a broom, that's them playing the system. That's capitalism, it's not their fault. It's the environment. Apple is simply better at business. Criticizing them is the same as the people who talk about "greedy Jewish businessmen" (I'm Jewish BTW). If you are getting stomped out in the market, for "immoral" business, then you got OUTSMARTED. That's it, and nothing else.

On the contrary, it's the best VALUE on the market in my opinion!

I use Android, but if someone asks me "what smartphone do I buy?", I without hesitation say iPhone4 for $99 on Verizon. Best deal going, you CANNOT get a lemon like Android where you might get a stable, great phone on day 1.. or get one that wasn't stable for a year. It's tough to say what you're getting as the Android system is more interested in pushing phones, than the motivation Apple has- customer satisfaction & hooking you into iTunes content. This is slowly changing on the Android side with better update controls supposedly coming down the pipe and a bigger focus on content through Play.. but it'll never match what Apple has built.

I know I've angered some Android nerds here, but I speak the truth about the market conditions. Apple is flat out cleaning up all over, and honestly I commend them. They have INDEED innovated. To say otherwise is just stupid. Their build quality alone has blown the doors off of everyone else, and what is Intel doing? Instead of attacking the high end of the market, like making a laptop out of single piece of aluminum- they are still attacking the bottom of the market in quality. Say hello to the Dell, HP method of market penetration.

The market was stale, boring and regurgitating ideas from the 1990's heyday of Wintel until Apple started pushing with OSX, iPhones, iPads, iTunes, iPods. I greatly respect Google's contributions as well, but Android really isn't the one on the top of their list.

The old days are over, and the market has embraced high quality products like Macbooks and Apple's mobile devices in mass quantities.
People got tired of HP/Dell/whoever's recycled garbage. Get over it.

I guess Apple fucked up if they're getting their patents invalidated in court. If Apple is the second to think of something and the second to patent it, does suing someone over that patent make them douchebags, scumbags, or both?

Actually, despite having a decent head-start over Android, Google has succeeded in their land grab. Apple's market share continues to shrink compared to Android, while people activate 1 million devices daily that aren't tied to iTunes or the App Store in any way. I don't own stock in Apple, Google or any other company in the smartphone business, so I don't care who's making the biggest profit. Google didn't create Android so they could charge $600 for a phone with a 45% profit margin; they created Android to make sure that Apple wasn't the only gatekeeper in the mobile OS space.

Worldwide, Apple's market share for the personal computing market is between 5-6%. It's still 92% Wintel. For the smartphone market, it's 60/20 Android/iOS. Samsung just passed Apple as the world's largest smartphone vendor this year.

Sure reads like you think there's some big deal to acquiring an iPhone. Or that anyone is clamoring for it's 'functionality'. (What, it's highly limited functionality and postage stamp sized screen?)

And work hard to buy one? What? $99 for a phone people give their kids?

Debating, should I pre-order one now . . . still have that nasty ETF but a TMO Monthly 4G plan is cheap enough to tempt me to just run two devices for a couple months.

Exactly, do these people think an iPhone would have multitasking or cut and paste or Siri etc etc without competition? Competition is what's driving the innovation in the mobile market.

Of course it would, contrary to popular Android fanboy belief, the majority of iPhone owners don't just buy a new model unless it offers something new over the one they own. Apple even without competition couldn't have released an iPhone 4S that was basically an iPhone 3 all over again without it being a big ass flop. Competition helps drive new features, but new features lead to more sales. And based off the slow ass speed at which Apple has been implemented the new features, it sure doesn't seem like they're doing it due to the competition from Google.

I think we might be seeing democracy vs capitalism right now.

Apple is extremely successful in a capitalistic way, but good capitalism isn't always good for consumers. They're making enough people mad (at least in the legal system) that people may start to vote with their feet.

They do it because they need people to keep buying new phones somehow instead of saying "hey look, there's a new Samsung or HTC phone that looks pretty sweet I can use my upgrade on. Maybe I'll try it"

so do you believe that if/when google is granted their notification drawer patent, that apple should be forced to remove ios5's notification center? that sounds just as dumb as google removing universal search from android.

God, I hope so. I think the "Notification Center" / "Notification Shade" is just a kludge, an "easy way" to deal with something that's not easy to deal with. Honestly, I was disheartened that Apple went the cheap route in iOS 5. I fucking hate the notification shades. On my device, I have every app turned off from the notification center so I can not look at it as often as possible.

So yes. I, for one, would welcome the court-ordered removal of the notification center. It would at least force Apple to actually think about the issue of notifications.

So, if you've turned off all the notifications . . . how do you know you've gotten a text, an email, an IM, a missed call, etc? You must miss emails and texts from friends all the time, and have a really long lag time between responses.

But, I doubt Google would begin a round of patent suits if granted the notification drawer patent. It'd be used to protect themselves and partners from Apple's never ending frivolous suits.

iOS still has the notification badge system. It sounds like he turned off notifications in the drop down shade.

If you're set up to guzzle LTE on your Nexus like I am, you'd be a fool to leave. You're consuming all the benefits right now.

Wait until the contract runs, get one of the Nexus 2013 options, and see if Sprint or T-mo have their act together on LTE by then.
But, I doubt Google would begin a round of patent suits if granted the notification drawer patent. It'd be used to protect themselves and partners from Apple's never ending frivolous suits.
Pretty sure they'd trot it out on offense immediately to force a broad cross-licensing agreement.

I have unlimited data right now, 'tis true. But in order to keep it, I have buy any future Verizon phones at full retail price. And at the end of the contract, there is nothing legally stopping them from moving me to a tiered data plan.

But until then, you should use the unlimited LTE to your fullest potential. You're already on contract and have the unlimited LTE. Why don't you test and find out how much max data you can consume in one month? Think 100 gb is doable? How about 200gb? F* Verizon. Abuse and test the limit. Maybe they'll get sick of you and allow you to break the contract penalty free. 😎

I have given that some consideration. I get crazy lte speed in my area. Blows my home comcast service away. I might buy a wireless card for my home pc.

Yes, I still have notifications enabled and they show on the lock screen, but I have disabled just about everything from showing up in the notification center. Because its worthless.

As a sidebar, this was THE reason I was hoping Apple's bid for Palm would be successful. webOS has a downright awesome notification system.
