Did you always have this problem?
When did the problem started?
What version of Nvidia driver are you running?

I suggest you update you driver first..
 
What resolution too? That is important as a single 770 may dip low at 1440p or 1600p when you're running lots of AA. Although Max Payne artificially limits your video options.
 
This is case of crappy PSU or crippled driver instalation.

Remove your driver and reboot, then use Glary Utilies/CCleaner then Driver Fusion and reboot again to the reinstall the new driver.

Could be a OS problem too, but it is much more likely to be driver's fault.
 
1080p should be fine with that card. Download gpu-z and verify your PCIe is running at the proper speed. Are you also sure the card is running at the correct clock speeds in games?
 
so already getting dips in bf3 to 20 in metro ll giving me 23 fps and now tested max payne 3 only 24 dips to 17 wt heck is going on...

So the problem isn't specific to Max Payne 3? If I've understood that correctly, you might have chosen a more appropriate thread title such as "Problem: Low FPS"

In addition to the advice already given (especially cmdrdredd's) you should check your various temps to make sure than nothing is overheating.

There are other things you can try but to be perfectly honest I've already put more effort into this reply than you did when writing the grammatical nightmare that is your opening post...

Dude an honest question, don't mind but are you using original windows? I somehow belive your pc has not been updated/has no proper av/is software.
 
yes but windows is updated till now but no antivirus windows is newly installed

Dude before playing BF3 do yourself a favor, download MSE and scan your system.You can also opt for various paid av/is products like KIS,Bitdefender,Norton etc etc.
 
Seriously check your PCIe port is running at native speed and not 1x. I had that happen once and believe me the experience was ugly. GPU-z is the easiest way to check this.

Also in your control panel make sure you aren't forcing ambient occlusion and msaa etc. and check that you set it for maximum performance and not adaptive just to eliminate that potentially causing dips.

I have to say that I am out of ideas. Outside of the card not running at full clocks the entire time there should be nothing to make it drop that low.
 

I compared your score to my score. Scrolling through the results I saw this. You should verify your CPU is running at the correct clock speed. If it's stick at 2.5Ghz you are essentially bottlenecking the GPU.
