And I, personally, find it interesting that, while you are giving lip service to the concepts of a fair investigation, you continually express yourself as if you know that he is guilty. And "PC" has nothing to do with it. I thought that justice was one of the ideals that Americans are supposed to believe in. Apparently, for some of you, that's not the case.

If you have that poor an understanding of the ideals that your country claims to represent I have to ask, unless you are old enough to have been drafted, why did you serve?

Not drafted....volunteered. That's a long story but I did it for my country. It's my opinion that he's a deserter. That's really a black and white action. Also, there is a level of PC to this whole situation although there is a much greater level of politics driving this as well.

That's the President's discretion.

You guys seem to want impeachment as the only means to uphold the law. When in fact it doesn't even do that, and something seen as a "nuclear" option hardly seems befitting what should be a regular and commonly used procedure to test the existence and validity of our laws.

Our present system holds lawlessness at its core. There are no checks and balances against the executive if only they can enforce the law. My proposal aims to restore that proper function of government.

For example... if the President orders or allows DHS to break the law, what today can be done about that? His lackey at the DoJ shouldn't be the only person who can address it. Congress, when given mandate by the Judiciary, should have the power to hold the administration accountable.

Sadly, we the public, may never see the specifics of what is presented in a military court. For one thing it may make politicians look bad and military courts are very similar but have unique processes/procedures that may restrict public access.

Bottom line though....he deserted....period. What other definition is there?

For one, there is the one that is official after a trial.

This is of course assuming he gets a trial by court martial at all. As politically charged as this situation is he may get quietly swept under the rug with a lesser punitive action as that's certainly possible. The decision to proceed is now with a four star general who may get some help with making that decision. Again, we'll all have to see.

I suggest the executive act in good faith as elected by the people to do so on their behalf.

The other two branches of government may be determine after the fact, if the executive broke the law and must correct their actions. Failure to correct should allow Congress, empowered by the Judiciary, to head up persecuting members of the executive below the President.

Forcing the President to appoint new cabinet members would both punish criminality and throw disarray into the executive, all the while allowing the Senate to grill new appointees on matters of importance before a vote. As a bonus, the American people would get to know exactly where their President, his cabinet, our Congressman, our Judges, and our Senators all stand on particular issues being fought over. Where everyone stands would be on public record during these proceedings.

Congress and the judiciary already have those powers through independent counsel and special prosecutors.

If there is no trial then there is no conviction and there is no person who is a traitor other than in some people's opinion.

Bergdahl has suffered enough for his sin, way more than any of the other 20,000 deserters. 5 years of captivity with BEATING to boot. Only a true sadist would demand more devastation to his life.

Tens of thousands of soldiers have deserted the Army after long, drawn out deployments in Iraq and Afghanistan in dangerous conditions, but the military has proseuted just under 2,000 cases, Military.com reports.

Over 20,000 soldiers have dropped out from the ranks since 2006, but only 1,900 cases have been prosectued. In most cases, desertion is usually easy to prove. Sgt. Bowe Bergdahl has been the main poster child for Army desertion after he abandoned his unit in 2009, only to be captured by the Taliban in Afghanistan and held for five years. A preliminary investigation in 2009 determined that he had simply walked away.

Anything is possible. The case could be dropped, or on the other hand, it could proceed straight to a court martial trial. Bergdahl may even be eligible for up to $300,000 dollars worth of retroactive pay, but desertion is usually looked upon as a serious offense, and even more so in conflict zones. Death as a maximum punishment is possible, but unlikely. It’s only been used once since the Civil War by General Dwight D. Eisenhower in 1945.

Not guilty yet. However I feel like they must have some pretty good evidence to support the charges or it wouldn't have gotten this far. Esp considering how the White House feels about it.

They did the right thing in getting him back to the US. After all he was a US Serviceman... sort of anyway. The price that was paid was too much IMO.

Agreed on all of this. As to the price . . . They know their relative worth as well as do we. Five of their leaders for one US deserter seems about right.
