how is this legislating from the bench, exactly? where there is an injury, there is a remedy. scalia loves that maxim. all that is being done here is allowing someone to try to prove there is an injury.

They don't know, "legislating from the bench" seems to mean "I didn't like that decision".

I see that xxxxxJohnBasha speaks volumes for his ethics.

One who cheats the system and feels righteous enough to sit in moral judgement of others.

Doesn't even have the morality to be honest.
