The grand jury no billed because there wasn't enough evidence. The police were colluding with the father and didn't investigate thoroughly enough.

Where's crump, holder, and sharpton to demand they arrest this racist for killing an illegal? This is obviously a hate crime and his civil rights were violated.

I am fine with rehabilitating pedophiles by beating them until the part of their brain that wants to molest kids doesn't work anymore. If other parts of the brain don't work either, or come out of the skull along with the bullet, then that's a risk I am willing to take.

What an injustice! Rapists are people too and this guy's rights were clearly violated! He's dead and a victim of not only this man who's daughter he was raping but the criminal justice system. Now we have a father out on the streets who could kill more rapists! Totally uncalled for!

HOUSTON -- A central Texas grand jury on Tuesday ruled that a local father who beat to death a man he reportedly caught molesting his 5-year-old daughter will not be charged in connection with the attack.

District court clerk staff told the Los Angeles Times that the Lavaca County grand jury met Tuesday and declined to return an indictment against the father in the June 9 death of 47-year-old Jesus Mora Flores of Gonzalez, Texas.

The attack happened at a horse barn between the farming towns of Shiner and Yoakum. Investigators said the 23-year-old father, who lives in Yoakum and whose name has not been released, ran toward his daughter's screams, pulled Flores off his child and beat him to death with his bare hands.

Emergency crews responding to a 911 call found Flores' body with his pants and underwear pulled down. The girl was later taken to a hospital for a physical exam and interview, officials said.

An autopsy by Travis County Medical Examiner's staff showed that Flores died due to "blunt force head and neck injury," and the death was ruled a homicide, according to preliminary results released to The Times on Monday by Lavaca County Justice of the Peace Alene Lyons.

But authorities said the father's account of the incident was supported by evidence and witness accounts.

Lavaca County Sheriff Micah Harmon, who had declined to press charges against the father, held a news conference at the courthouse with other officials after the grand jury met to announce its decision, but could not be reached by phone afterward.

"The substantial amount of evidence showed that the witness statements and the father's statement and what the father had observed was in fact what had happened that day," Lavaca County District Attorney Heather McMinn told reporters, including CNN.

Neither officials nor the family's attorney, V'Anne Huser, took questions.

Huser said in light of the grand jury's decision, "in our opinion, today, the story is over."

In 1994 or so, a guy's car was reposessed. the owner went into the house, got his scoped rifle, and shot the reposessor in the back. The shooter said he thought his car was getting stolen, so he was not charged. If I wasn't a lazy bastard, I would go look it up, but I am too lazy, do your own research.

Damn I hate the media spin "alleged molester", like this guy was the victim instead of the father and his daughter.

OMG! The death was ruled a homocide! No shit it was a homocide, that was never in question. But according to law, it was fully justifiable homocide - aka, no crime commited by father.

"Seems we have quite a few instances here in the US where murder is acceptable. So this man deserved the death penalty for what he did, is that the prescribed punishment for raping a child? No, it is not? So, then, why is this man not facing chargeds? Third degree manslaughter? Assault wih a deadly weapon? No, this man should not have walked away scott free, its not right. Screw Texas and Texans; they are barbarians, as far as I can tell. All they want to do is kill anything that ain't white. That is not right. I'm not condoning rape, but the guy didn't even get a fair trial, and is that not what supposed to happen? Isn't that the whole point of our supposedly hallowed, democratic legal system? One gets a fair trial? That goes for if you commit the crime, also; you get a fair shake..."

So this commenter believes in the law but not the law in texas which says what the father did was legal. Hell even if it was not legal (in some place I would not want to live) I am sure you could get away with it by pleading temporary insanity.

This father was lucky. Think if there was not evidence to show the crime happening or if he caught the molester too early for evidence and then he would be raked over the coals a second time, the first when his daughter is attacked and the second when he has to defend himself in a trial in and out of the court room.
 
Having read some more details, it seems obvious that the father not only did the right thing, but that he absolutely should avoid indictment.

He saved his daughter, then actually tried to get help for the molester when he feared the man would die. Forget indictment, the man should get some sort of prize.

It's fucking sad that people have to defend this father. I'd love to meet some of these apologists in real life.
