You can refuse to do the FST, breath and blood test but you will get arrested and your license suspended under suspicion of DUI. You are forced to give a blood test during no refusal weekends if you refuse a breath test.

Ah, yeah it's been awhile since I was in Texas and since I don't drink and drive, I don't pay much attention to the specifics of the law. I just know that refusing will result in an arrest 100% of the time.

I will limit myself to ONE drink if I am out at dinner because I know if I got stopped that I should be clear of alcohol after an hour or so. And if I was stopped, I would 100% refuse any breath test or FST and be asked if I am being arrested to be taken to the hospital and given a blood test if they will not be doing one on me at the station.

I have 7 years of college level science. I know science whole-heartedly.

Calibration and the proper sampling must be done for any test to be valid.

From a scientific stand-point the Breathalyzer is a flawed test because it's an indirect measurement done because an invasive test would be too complicated.

Just for the record, MADD's founder never intended to limit anyone to 2-3 drinks. She never intended to bar anyone from literally drinking and driving.

I didn't refuse the breath test because I knew I was not drunk nor anywhere close to the limit that night. My FST's were perfect, my replies to all the officers questions were correct (no one ever gets the backwards alphabet, but I learned that when I was young...the officer wrote it down 3 times in part commenting "gibberish". It was accurate).

I am not claiming I have never gotten behind the wheel past my limits, however; those days were long past me by my mid to late 20's.

This was some kind of perfect storm and one I learned a lot from.

Texas is one of the few states that you consent to FST's at the time you get your license. Most states you can refuse (you will be arrested so a blood or breath test can be performed).

Most lawyers do recommend refusing the FST no matter what as most look like drunk fools doing them anyway. Many adults can't do a one-legged stand well nor walk a virtual balance beam accurately.


Even the three tests recommended by the National Highway Safety Association are far from perfectly reliable: the one-leg stand has a 65% possibility of predicting whether or not you are above the legal limit, the walk-and-turn has a 68% percent probability, and the horizontal gaze test has a 77% probability.

Did you, or did you not get your blood drawn? You keep deflecting. Just answer me. You have not made it clear whether or not they just never offered it to you, or you didn't bother with it, or if you took it and your BAC was still close to .168%.

Of course and I agree. People whom are responsible adults should be allowed alcohol. The thing is, if you are drinking and you know you will be driving, limit yourself to just 1 maybe 2 if you will be out all night long. It's a seriously bad idea to drink any more (look at you) than that even over the course of many hours.

Glad you learned but that doesn't mean it's cool or okay to drink and drive, nor is it excusable if you are caught. The harsh and ridiculous costs served its purpose no? Have you gone out and driven on a .168% BAC again? Or even anything remotely close? I hope not.

A .08 blood alcohol level is several times more likely to have an accident than zero.

You can't defend that as ok to do.

I totally agree that 0 is best.

Most of our civilization doesn't live at that marker in parts where cars and SUV's drive around in cities.

We are all OK.

Personally, I'd love to be a vegan, play in the ocean all day with a hot woman (to me) and not worry about money.

If you can figure that out, good luck.

Like I said when I am drinking now I don't drive. There is no way I want a 2nd DUI. I drink too much at times, but I am not a meanie nor want to get into my car to prove a point.

I asked for a blood test once the breath test was performed. In Florida, once that was done you got to a holding cell for 8 hours. They laughed at me.

Now you are trying to taunt me. The person that started this movement didn't believe in 1-2 drinks.

Figure it out.

I'd pay attention to your other forum lies. 🙂 That's really how I work, lift, fuck, rinse, repeat.
