I mean, on one side I feel he's being ragged on a bit too hard, but on the other side I feel like he's digging himself a hole for no reason. I wonder if he thinks if others here (including me) are not going to relink this shit every time he posts from now on. If he lies about his DUI then I'm sure his advice elsewhere is trustworthy, right?

I also feel sad for his offspring; I really do. You win some, you lose some I guess.

I am paying for a fucking iPhone every month for a friend of one my those kids that has a mother that now has brain cancer. We also gave them $100 tonight, because they got thrown out of their rental today instead of Saturday. They can drive to their new home tonight with that $100. The guy that married his mother is out of the country until Saturday and has no phone access and they don't have internet at the house.

This ordeal he is going through was 7GB of data on my plan so far this month. I had to call him two days ago to ask what was up and he kept saying he was sorry. I finally confronted him to tell me what is going on.

I am not a bad person.

I explained it above. I was not intoxicated. The video and my replies to the officer's questions showed that.

"I can speak clearly at 0.168 and that should have been enough to prove that I was okay to drive, but the darned officers just HAD to make me blow and find out that I was more than twice the legal limit. Damn them and all their science-y nonsense!

You do realize when a Law Enforcement official says that, he doesn't mean "drunk" in the casual, pedestrian sense. He means drunk according to the law regarding level of impairment.

Of course it wasn't known because they had to wait for the blood tests to get back since they couldn't get a breathalyser result due to him being dead and all.

Let's consider the facts, laid out by none other than you. You blew a .168 but did not "feel" drunk...Heck you apparently even passed all the roadside tests. Additionally, you claimed to only have 4-6 drinks over 8 hours, yet...managed to still double the legal limit.

Having "blood in your mouth" is not going to make you go from .001% (negligible amounts) of alcohol in your system to .168%, I don't care how off the machine is, unless it was completelyyyyy broken, in which case you and your dipshit lawyer should have had an easy case in your favor.

Lastly, why do you even bother in this thread right now man? You keep retorting over and over trying to prove you're a good person to some anon. internet people. You will never win.

First, I don't think you understand how a breathalyzer works. One of the flaws they have is they measure the alcohol in your blood from the blood in your respiration. In science, if anyone was trying to prove something such a method would never be used.

People all have different amounts of blood in their respiration so an average is used. This could be enough to go 0.1 either way...possibly more or less. There hasn't been much tests done when someone is actually bleeding esp. into the machine. I had no reason to refuse the test as I thought based on the field side I was fine and just being harassed. I should have requested a blood test which would have cleared me. I found out about the way this all works too late and prior to this was a big advocate of MADD/SADD.

Lol, it's not an 'easy case' in the sense that the witnesses would run about $10k minimum, I could have been potentially looking at 3-4 of them (a breathalyzer expert for both the prosecution and defense, a doctor to testify my injuries would have put blood into my mouth) and the case could run for up to 2 years during which I would not be able to get a work permit and have to be taking cabs back and forth to work. You cannot self testify that the machine reading would be flawed nor that your injuries would have left blood in your mouth (there is a legal/scientific term for this in DUI defense, I have forgotten it). The witnesses have to be at each trial, in case they are called. You have to provide the travel and room/board for them and they don't travel cheap.

When all would be said and done it was $5,000 vs at the very minimum $20k and more than likely $30k+. Even the lawyer said it simply wasn't worth it, I would not gain anything by this unless I was going to be a commercial driver of some kind anytime soon.

Also in the State of Florida winning a DUI case is hit or miss across the board. It's really screwed up due to mandatory minimums and the like.

I am not saying I am a good or bad person, I was explaining to those that have no clue how common it is to be arrested for a DUI. What needs to happen is the rules getting stricter for repeat offenders esp. those getting into accidents. However; the money is not there for that and it's much more lucrative to pick up young professionals each weekend to the tune of $5k-10k a pop in legal fees. Much easy than pulling over speeders and reckless drivers, going after gangs/murderers, and the like.

There are over 1,000,000 people per year getting arrested for DUI and most of those would have never harmed anyone.

People can take my story as a lie or whatever, that said my track record here shows I have not had to fabricate anything in the past. I would not have brought this up if I wasn't being factual.

I am not recommending drinking and driving at all. I do not do this. The fact is if you know someone that's died of a DUI, what you don't know is you have friends and family with a DUI they haven't shared with you.

It was obviously still over a .08 or you wouldn't have been charged and convicted with a DUI. Also, if you knew you were not drunk (how could you be if you only had 4-6 beers in 8 hours??) then why did you even submit to the breath test and field sobriety? You should have denied the officer (you do know you can refuse these, right?) and just had him take you to the station, gotten your actual blood test, shown you were not actually intoxicated and then been released.

And just because millions of people drive drunk every year and get away with it with out harming anybody else, doesn't make it forgivable or okay. You are playing with fire when you get behind the wheel like that. I'll admit, I drove drunk a few times in college, but it was only about 1/2 of a mile from a bar back to my house on roads which don't really have traffic late at night. It wasn't right and had I been pulled over, I would have deserved to go to jail. I can't go defending drunk drivers just because I and others have done it "safely". The reason it's so expensive is because it's a really really really bad idea and it's a pretty solid way of deterring people from doing it again.

Why wouldn't he be? He murdered someone. Pretty sure that is illegal. Two wrongs don't make a right.

Actually, in some states, refusal of a field sobriety test is grounds for arrest on suspicion of DUI. They then take your blood to test. At least, that is how it was in Texas.

You are ignorant to the facts. One, a blood test is not given automatically nor ever after the breath test at the station.

Two, you can still be arrested even if your BAL is below the limit.

It's way more than a million driving drunk that's the number that get arrested and most of these people are not hurting anyone.
