yeah, this guy is going to get off, and rightly so. Had I watched my (hypothetical) kids getting killed I wouldn't have gone home to get a gun though, i'd have killed the guy with my bare hands right then and there.

A lot of people break their necks in car accidents...

The part I question is: David Jr. died at the scene, while Caleb died later at a hospital. Did he go home to call an ambulance or did someone call from a mobile phone? If one of the kids were still alive why would he leave their side unless it was to call 911.

Would you have your kids push a car down the shoulder of a dark, winding country road? Seems like someone sneezing or changing the radio could easily swerve onto the shoulder. Just seems like a bad choice.

I'd leave the car there until the next day, or call a tow truck.

What idiot pushes their car at night on a dark road? He shares some of the fault for his own kids death. Then to go and get a gun and kill the guy who hit them is murder.

Edit: btw it says the driver was suspected of being drunk. What was his BAC? Weird it wasnt included in the story.

It does not matter. A driver is suppossed to be aware. If not drunk, it is still "reckless driving" and you cannot kill someone. Accidental(whatever the legal term for this is) vehicular homicide, is still a very serious ccrime. And it can still push a father over the edge.

Maybe ran home, called 911, and came back out with a gun and shot the guy dead.
Or told his wife, grabbed a gun and shot the guy dead. Meanwhile the wife calls 911.

It was only 50 yards from their home.

I would think the father should pause and reflect upon how his poor choices placed his children in a position to be harmed.

They were close to home (50 yards) and it likely wouldn't have taken long for an able-bodied adult and a 12 an 11 year old to push the car. Who the hell calls a tow truck for that?

And it might have been a dark road, but it's more than likely that they had the headlights/taillights on so they could see what the hell they were doing.

Again, insanity. Seeing your children die = logic, understanding, and sanity is out the window for a while.

I've known several people to have heart attacks or go into diabetic shock and lose control of their vehicle. Unless there were bottles of booze in the car or you could smell it on them you'd have a tough time telling a drunk person from someone going into a diabetic shock. Have fun explaining to a family that you executed grandpa becuase he overshot his insulin needs.

Why wouldn't he be? He murdered someone. Pretty sure that is illegal. Two wrongs don't make a right.

That is only if you consider killing a drunk for slaughtering half his family as "wrong".

I'm having a hard time classifying it as wrong.

He deserves punishment.

#1 He left the scene to go get a gun, he had plenty of time to think about his actions on the way there and on the way back. shows premeditation

#2 he ditched the gun. shows guilt.

#3 he was so consumed with rage that he did not even bother to call a squad for his wife and 3 year old and stay with them until it gets there (nothing noted in the story)....what asshole leaves the scene of such and accident so he can kill someone without getting care for his surviving family?

It is a tragedy that his children were killed but he deserves jail time. But like someone said this is Texas...he'll walk.

Good shot, I hate drunk drivers, they are the lowest form of life...not even worth calling them human. If you can afford booze you can afford $10 for a cab or a friend to drive you.

Still a crime and a long prision sentence to accidentally kill someone with a car. And not meeting the needs of insulin, can fall under "reckless driving" as the person was not prepared to operate a vehicle at the time and for how long of a period.
