The DA will hear that a retired cop is testifying for the defense and drop the case...
The cop will have the DA killed and then run for DA himself. He will get elected and have one of his underlings try the case.
In the meantime, he will impregnate the OP's wife with his demon spawn and the baby will be born and immediately eat the OP.
The old witness will have a heart attack upon hearing this the cow will jump over the moon.

I had a similar thing happen to me. I was pulled over for having a headlight out. When the officer came to my door the officer asked to see my license and registration and proof of insurance. My reg and insurance were in my glove compartment. I took off my seat belt to get my reg and insurance in the glove compartment. Cop goes to his car and comes back and gives me my ticket, which I assume is for the headlight. I get home and check the ticket...no seatbelt!

Anyway, I went to the initial hearing and after talking with the DA he offeres $15 court fee, no record, no points. Done deal!

See what the DA will offer. Tell him/her you have a credible witness (retired LAPD) and see what s/he offers. I don't think it's worth your time and money for some vendetta that you will lose. Just get it done and move on with your life.
 
just got falsely cited for not wearing a seatbelt (I had it on the entire drive of course, as I ALWAYS do). Boy, did he pick the WRONG guy to try and revenue. Now I get to go through the whole martyr thing, refusing to pay the fine, court costs, etc...and I'm pretty sure I'm going to file a small suit as well, requesting my time and emotional damages. I won't win that, but it seems like the right thing to do.

On top of everything else, the driver of the vehicle is a retired LAPD officer. ROFL.

Courts charge you for their time, seems only fitting to pay them in kind. And without question this kind of thing exacerbates my distrust and dislike of governments, and causes me stress, which is a direct physical harm (especially to someo...ne with a heart condition who's already in a very stressful situation). I'm planning on charging for my time (researching, preparing, and attending court, @ $15/hr, and then $125 distress, which is $1 more than the ticket is for). Like I said, I know I won't win that one, but it's the right thing to do.

Unless the offer is $0 and no record, he can go piss up an electrical pole. I refuse to be charged with something I didn't do. Period. I would kill, die, spend life in prison, lose my license, lose absolutely everything, watch the world spin into the sun, etc. There is no such thing as degree in my life, there is only right or wrong.

Yes, I realize most people don't get that, which is fine. Most people aren't idealists.

But maybe tone back on the death threats. Killing someone because you were wrongly accused of a seat belt violation is hardly the ideals one would want to mold your life after.

Yeah, cause I'm planning on walking in and saying I'll kill you if you charge me. LOL. I'm just saying there is NOTHING I would do or endure over a matter of principle. Always. Period. I've proved it time and time again, so people that know me accept this as utter gospel. Sometimes it bites me in the ass, sometimes it bears fruit. I don't do it for the outcome though, but because it's the right thing to do.

I'm betting when I hit court with the retired cop on my witness list, a well-known reputation in this tiny town/county, and an absolutely spotless record, they sweep it under the rug and let me off. If not, then we'll see what we'll see.

Still, anyone can make a mistake, and two spotless records contradicting one unknown, even a cop, should be a done deal. It may not be, with how badly the government needs revenue, but it SHOULD be.

I used to see the world as black and white. What was right is right and what is wrong shall not be tolerated. Yep, that lasted til the seventh grade when I discovered the world was united...................against me. It's for the noblest of causes - truth, justice, right, etc. It's just sad that I still may not win even so.
