When the counterfeit product is more convenient than the legit one you have a big problem with your model of business.

Why should I care about american media corporations producing movies and music?
Your country wouldn't think twice before moving war to a regime my country has good trades with (infact you did it and for few months there were billions worth of oil extraction plants and the jobs related at high risk).

Sucks to be you guys, it's like having heavy investments in horse shoes production while cars are becoming popular.

So when illigal FREE cpoies of your prouct is made available...you buisness model is flawed...WTF?

- DRM that prevents people from playing your product if the drm server is offline

- cinavia

- securom

- installing rootkits (malware) when you want to listen to audio cds on your computer

- audio cds not playing on standard compliant players

the list goes on and those are clear examples where the customer is punished while the pirate laughs at your futile attempts to stop him.
I don't support people who in return for giving them my money make my life more miserable.

The vast majority of piracy isn't about money. Yes there ARE people who are just trying to get free stuff. But that is rarely the cause.

I would also like to point the massive amount of people who buy a product and then "pirate" the product they already bought because the pirated version is better.

ES's arent counterfits, there originals.
ES's always belong to intel.
ES's when sold, is being sold outside intel's knowledge.
ES's can be recalled from intel at anytime.

A good example is, you went to a car company and borrowed a car.
They told u, you could drive this car anyway u like, you can even total it, however you can never RESELL IT.
Then you decide you want to pocket money from a item you got for free.

^ this is illegal.

i dont care how you look at the situation.
You bought an item off someone which never belonged to you to begin with.
And if Intel ever finds out, they will ask you to return the item without refund, because you ended up buying stolen property.

And if u think Intel wont ask you, your wrong my friend.
Ive had to return a couple of CPU's even because Intel asked my source to return CPU's with Serial numbers XXXXXX, because they thought those cpu's were on EBAY when they werent.
When the cpu's in question were returned, intel appologized for the inconvience, and even ended up giving my sponsor Retail boxes of cpu's i returned as an appology.
And yes my sponsor was an intel partner.

Dont get an ES.
They dont have any advantage on them other then the time factor.
There not unlocked or magical at all anymore.
And they most definitely dont hold any type of warrenty, and infact typically even holds some ERATA bugs which arent worked out until retail versions hit.


Last note.. my sponsor was telling me about the madness that was going on with intel and ES's being sold.
One time a Intel Rep asked my sponsor, how did u like those 15 ES's i mailed you to test.
My sponsor told him what 15 ES?!?!? i only got 5....
They checked and guess what? the 10 more he should of gotten never got there, because they were sold and found on EBAY.
^ meaning somewhere someone stole 10 ES's which were suposed to goto my sponsor, and decided they'd make a quick buck off them without intel ever finding out.

Well, needless to say, a few people got terminated from intel after that, and a few even went to jail.

Specifically, theft. Tangent about piracy aside, ES selling is theft and a different issue from piracy.

There is however a question of intel reclaiming the chips or demanding their partners destroy them.
Hypthetical scenario:
Intel provides company Z with an ES chip. Company Z says they are done with it, does intel want it shipped back? No Intel wants company Z to destroy it. Employee A of Company Z is being lax and instead of destroying it, simply tosses it in a trashcan. Employee B of company Z takes it out of trashcan and resells it. Employee A and employee B did not conspire together.

Has a crime been committed?

You should know how many previews i have done with CPU's which made people HATE me on this forum. :D

INTEL SAYS:

1. You either DESTORY the cpu when done. (Not toss them in your trashcan)
*if u recall i did a LOT of stress testing / Killing of CPU's back in the days... there was a REAL reason why i had to kill them, even tho most of the guys on the forum would CRY when a 700 dollar yorkfield was put on the oven and stressed til it pop'd*

2. You either RETURN the cpu when done. (again... does not mean throw them away inside a trashcan @ intel)
3. You keep the CPU FOREVER INHOUSE when your done. (does not mean trashcan inside your office as storage)

There is NO EXCEPTION to the 3 rules with real ES's and NDA's.

Anyone whose held a NDA will tell you that, and anyone who still gets offered NDA's will tell you that still applies.

I am aware, but what does that have to do with my scenario?

If intel asks their partners to destroy it rather then toss it in trash and the partner fails to do so. Then no law was broken...
The partner might have failed to uphold their side of an NDA contract and intel can extract damages from them. But the person who picked it out of the trash did not violate a law. And its not actually stolen property since it was thrown out. Yea, they meant to break it BEFORE throwing it out... but that's their problem.
