The problem is, they've already dispatched Two-Face and Ra's al Ghul, established Scarecrow as only a minor villain, and can't use the Joker because, let's face it, they aren't going to be able to copy Ledger's performance without it seeming very poorly done. This Batman incarnation is relatively realistic, so there goes Mr. Freeze, Poison Ivy, and Clayface. All they really have is Catwoman, who really wouldn't be a good main villain, the Penguin, who really would be hard to develop as a character, and the Riddler.
The Riddler can be done in the dark, gritty style of the Nolanverse. He will be the main villain of the third film. But I doubt it'll be Eddie Murphy.
