Okay, I need some helpful tips here. Two weeks ago I sold a Track IR 5 with hat clip and track clip pro on Eaby for 109 bucks. He got a deal as the Track IR 5 costs 150 new. So after two weeks without even leaving me feedback I log into Ebay and see this guy has opened a case on me saying the item was not as described he said the track clip pro was broken. Now that is just BS because the track clip pro was never broken when I shipped it and I never even used it because I don't have a headset for it. I even shipped it in bubble wrap and these things are made of solid plastic. There is no way IN HELL! that this could have broken unless he broke it himself which I think he did.

My question is how do I fight this so I don't have to issue a damn refund on his error? I don't have that much money and in fact I only get around 478 dollars a month from SSI. I can't afford to shell out 109 dollars to a little bastard that broke my Track IR.

Do you have a picture showing it wasn't broke? If so you have proof it wasn't broken. If not you paid for postage insurance right?

Helpful Tips
- Take accurate pictures of the item before you ship it.
- If > $250 you need to get signature confirmation delivery
- It is up to you to pay for the insurance. Build it into the price if you have to but if the item arrives damaged it is on you.

If you don't have pictures or insurance, you're screwed. This is one of the reasons I prefer craigslist.

The good news is that you don't have to report your extra income to SSI since you aren't getting that extra $109. Around here (NJ) that would be subtracted from your SSI. Paypal does report that kind of income.

In my experience it's expensive to argue with ebay.

Your loss. Sellers get shafted on Ebay all the time. You're gonna have to refund, but only do so once he returns the merchandise. By default, buyer pays return shipping. At the very least make him do that. If he skimp out and ship without tracking then you have a case against him.

Yes, the pictures are in the auction and hosted on Photobucket showing the item not broken. I used to take pictures of the item in the box too but I didn't do that this time. I did not purchase insurance and wouldn't that be up to the buyer? Meanwhile my paypal account shows a negative 155 dollars. So much bull shit. The guy clearly broke it and I refuse to issue a refund. I just bought a digital camera and will for now on when selling on Ebay to take a video of the item.

Your allowed to earn income up to a certain extent, only problem is that after a percentage is met the SSI (or part of it) can become taxable..

He can get confirmation of deliver from the post office. I do it when I sell my items on ebay so the person I sent it to cant claim that it didn't arrive.

The guy would have to be a moron not to use any tracking. This is just on the off chance he forgets or too fucking cheap. It may be YMMV as it all depends on the Ebay Resolution CSR, but not receiving the item back is a good case for rejecting the refund. The buyer claimed item is broken therefore he can never claim he didn't receive it. Now it his burden to return the item with proper proof.

I had this happen to me on an item that was not exactly cheap to ship and the buyer simply refused to ship. Fortunately for me he got all pissy and wasn't making himself look good. The fact that he went directly to Ebay Resolution Center without communicating with me wasn't good either. In the end Ebay sided with me.

How could you have not known what was going to happen? This board alone has a thread nearly every 2 weeks with this exact same topic. Ebay sides with the buyer period always. No recourse, no discussion. So they sign up, rip off a few people, finally get the account banned, and just sign up again and start the ripping all over.

Unless you can move enough product so that you can absorb the losses when this happens it's just not worth it.

Well I don't know how people can have some 10,000 feedback score. I'm going to fight this tooth and nail. He isn't getting anything back PERIOD! It took the douche 2 weeks to come up with a case against me and he clearly is trying to rip me off.

ebay sucks so bad now, I take video of the item and the packing process.

ebay + paypal = seller loses.

Don't even bother trying, you will lose.

Yep, SunnyD has it right. It doesn't matter how much you document anymore, 99% of the time they side with the buyer. End of story. Ive sold things on there clearly labeled in the description and title as "NOT WORKING FOR PARTS ONLY NO REFUNDS" only to have buyers file a claim that it didn't work and they win the case and get a refund. Depending on the value of the item, if it was low they didn't even have to return it.

Do you know anyone in the city/region where he lives? Sometimes the best way to deal with people like that is to go and beat the living hell out of them in person. Don't let him know who you are, or why he's getting his head kicked in, just let him get a severe beatdown like every scammer should. Ideally don't paralyze him or anything, but at least knock half his teeth out, dislocate his jaw, that kind of thing.

The problem is you don't have any evidence that he's a scammer. There's no sure proof that the item didn't break during shipment. Ask for return, refund and move on. Being angry doesn't help your situation.
