I won an ebay auction and got a winning "thank you and pay me" email.

In addition, he also sent me this:

"Dear b_macd,

hey you just won my auction. I am really sorry but with 10 hours left in the auction I took inventory and I was 1 phone short. I was unable to end this auction becasue you have to do that with more than 12 hours left. I am a very good seller and this was not intentional in any way. So please don't make a payment. I may have more of these phone's in the future but right now I simply don't. It was my mistake and I own up to it and I apologize for any inconvenience this may cause you sincerely Steve Masted."

Since he appears to be able to get more phones in, I asked when he was going to ship it and let him know I was disappointed that not only was my bid a contract, but him having an auction was just as much of a contract. Here's how he replied:

"Dude did you read what I wrote below I made a mistake I miscounted I had no way of ending the auction or putting a note in there I didn?t realize it until it was too late?sorry you?ll find another one jeeez?.what do you want me to do magically produce a phone I don?t have????"

Just reading through some of his feedback and he will give you a negative for sure...he sounds like a grade A douche

Just let it go. People make mistakes. It seems that he was selling several of them, so maybe his story is true.

It's probably some 15 yr old Focker behind his mommy's computer. Leave him negative feedback and call it a day. Ebay has pissed me off as well lately it just gets worse and worse everyday...

that phone looks like a steal for the price you won it at. and he has an attitude problem so i think you should return him the favor....bug him, get him to get one or hold one for you when he does get one for that price you won. report this to ebay. (assuming i'm right about it being a bargain)

If you saw an ad in the paper for something, went to go buy it, and they told you they were out.. would you go around and talk negatively about that store because of that fact?

Look at it like this. He listed a FREE mutual positive feedback, you bought it. Now give it to him and he will reciprocate.

Like I said, this has not inconvienienced you at all. At least not compared to the inconvienence of potentially having a negative feedback and having to pay listing and final value fees. Sure, you may be disappointed you didn't get a good deal, or that you have to shop around some more.. but you aren't actually out anything.

why tell him to let it go? i say report it to ebay and let ebay give the seller a warning. a seller once reported me when i failed to buy something i bidded on, and i have a strike...2 more to go and my acct will be shut down (i dunno if those strikes will go away after a certain period of time though....like a speeding ticket)

Ok, what the fvck is wrong with you? He would either leave a negative or nothing at all. Leaving a positive feedback is just plain stupid. This seller is an asshole and if you can't see that, you're blind. He listed a phone on ebay, then all of a sudden "10" hours before the auction ends he can't "find" the phone. This happens yet he doesn't bother adding to his auction. Why? B/c he wanted to wait out the bidding...for the right amount of $$, he would have "found" a phone.

bmacd doesn't pay any fees at all and your paper analogy is just irrelavent.

he would have left me negative feedbacjk without hesitating had i written him a letter that said, "sorry, i was just looking and didn't mean to bid". Essentially, he did the same thing, "sorry, i made an auction and don't have the product.".

I'll see what happens after this weeknd.

By emailing you and telling you that he made a mistake, he is providing you with good customer service. Now reward him!

Selling something in the paper =/= ebay

5.2 Binding Bids. he's out something??? are you kidding me! if anybody, the seller is gaining from not selling the phoen for less than 200 cuz he can then sell it to somebody else for more. the buyer here is losing on this situation because the net worth of that phone is more than 200.
