I won an ebay auction and got a winning "thank you and pay me" email.
In addition, he also sent me this:
"Dear b_macd,
hey you just won my auction. I am really sorry but with 10 hours left in the auction I took inventory and I was 1 phone short. I was unable to end this auction becasue you have to do that with more than 12 hours left. I am a very good seller and this was not intentional in any way. So please don't make a payment. I may have more of these phone's in the future but right now I simply don't. It was my mistake and I own up to it and I apologize for any inconvenience this may cause you sincerely Steve Masted."
Since he appears to be able to get more phones in, I asked when he was going to ship it and let him know I was disappointed that not only was my bid a contract, but him having an auction was just as much of a contract. Here's how he replied:
"Dude did you read what I wrote below I made a mistake I miscounted I had no way of ending the auction or putting a note in there I didn?t realize it until it was too late?sorry you?ll find another one jeeez?.what do you want me to do magically produce a phone I don?t have????"

What do I do? Should I chance leaving negative feeback and hope he doesn't leave it for me? Should I keep bugging him asking when he's going to get this phone in?
