Ebay problem, never had this issue before...HELP! UPDATE

Request his personal information from ebay and keep records of your attempts to straighten this out with emails, phone calls and dates. Ebay has a fraud protection program and can refund you about $175.00 after jumping through a few hoops. I hope you can prove that the money order was cashed.

well, i'm going to call him tomorrow with the # provided by Ebay and see what happens, any other help would be greatly appreciated

well, i called and left messages 3 times now, and i filed a complaint with square trader, my next step is going to be legal as he is leaving me no choices here. Anyone else have an idea of what to do??

I SMELL TROLL!!!

File a complaint of Mail fraud with the US Postal service AFTER you have had them trace the money order and confirm that it has been cashed. Once this is done, also file a police report with your local police, and get a case number. Next, call HIS local police department, file a complaint with them, give them the case number for the one you filed in your home town. Get a case number from his police department and provide that information to your local PD. Now, the police both have referencing case numbers. Also, make sure to inform each department of the Mail Fraud case, and if the PO gives you a case number, provide that to each Police department as well. Save all copies of emails, instant messages, etc. Write down dates and times you have attempted to contact him. Provide as much detail as possible to each agency involved.

Nope, Troll Hunters cannot really get involved in Ebay issues, plus, they have tried to help Ebay out on many occasions, with only a slap in the face from ebay as thanks.

Ah, thanks, never had a problem trading before, so I wasn't sure. Hence the "Maybe" :)

don't wait on this guy anymore. Based on his actions, he's trying to rip you off!
Contact the appropriate authorities and also inform him that you will be calling his local police department. Use his name, and find his phone number. I'm sure he's listed in the white pages. Don't just give up $250 like that

EDIT: just read your last post. Don't stop with your local police department. Also contact his.

This guy seems like a complete tool. How much time has elapsed from the close of the auction that you won? I always give my buyers plenty of time if they are communicating with me and letting me know what's going on. I think that he should've given you more time anyway considering that you thought that he took PayPal and then switched gears on you.

I personally wouldn't have even dealt with this Ahole in the first place. Just look at his auction. Could he use any smaller print for his terms and conditions?

Sorry about your case, bonk.

I hope this serves as a lesson to future buyers to send Money Orders via a traceable method (I prefer FedEx w/ a signature required), especially when such a large amount is involved. Those MO's are as good as cash to an experienced scammer.

The following is the response i just got from this guy,
and he then blocked my email address so i cannot send him mail from my aol account, hmm, sounds fishy huh? I plan to contact the USPS tomorrow along with his local Police and start filing my complaint. This really bothers me, everything i do to try and help this situation, he does something else to make him look that much shadier, i can't freakin believe it..!!!!



Dear sir,

It has been over 2 weeks [17 days] since the auction ended and we have NOT received your payment as of 4/7/03.
We have no way to verify whether payment was ever sent since a delivery confirmation was not attached.
This simple, inexpensive form of tracking should always be purchased prior to mailing any item of importance.
The fact that you may or may not have some sort of MO receipt, doesn't help us since it's veracity cannot be verified by us.
The bottom line is that no payment from you has been received and, at this point, we do not expect to receive it.
It has also come to our attention that you violated the terms of our auction by placing your bid. Our auction specifically stated:
"IF YOU ARE UNRATED OR HAVE ANY NEGATIVES
FOR NOT PAYING, PLEASE DO NOT BID ON THIS ITEM."
The fact that you have negative feedback for nonpayment, and originally offered us trade items in hopes of acquiring the RPTV, does not inspire confidence that we will ever receive payment.
At this point, given the fact we have not received payment, your negative feedback history for nonpayment, and the sour tone of your last email, we have relisted this item, as per eBay's rules of auction.
If your "phantom" money order ever arrives, it will be returned to you.

no thread crapping, u should be responsible for part of the problem.

You should mail it w/ dc or whatever so proof of mailing / delivery can be used in favor for u in this case

damage control advice : check with your PO to see if the USPS MO is cashed, if so, ask for a copy of for proof of cashing, which should give u info about where/when the MO is cashed.

dig up his phone # using ebay member search tools. File a complain with ebay if his info is invalid & outdated.

remind him that mail fraud is a federal offense.

I seriously doubt local authority will care about this, good luck anyway..

Maybe he didn't get the money order?

Go to the post office and get a trace done. Maybe they will just refund your money if it turns out that it has been lost in the mail.

funny thing is, if he really didn't get the MO he prolly thinks he's the one being ripped off. you cant do anything until you know it's been cashed by him. so find that out first, then you'll know if you're being ripped off. and yea, no offense, but like the last guy said you should always go with delivery confirmation/tracking.

well, somehow this troll managed to get my account suspended because now i cannot even log into ebay. gotta love it. I swear this is 1000 timens more trouble than it should have been. i'm really pissed right now and going to go find out where the hell this money order is and who's possession it's in. God this sucks...

This is what you should do. Since you offered to fax a copy of the money order receipt and he didn't accept, cancel the money order. You have no way to stop him from cashing it. I would cancel as SOON as possible. Secondly, I would organize all the correspondence and evidence in a logical format, and send it with a brief letter to ebay support. Show them you held up your end of the bargain, and they should unlock your account. Ask them to lock his, if possible. Also, leave an honest, accurate negative eval on his profile. When I do use ebay, I make photocopies of everything and also send money with a return receipt. That way I know someone accepted the envelope and have a signature to prove it, and that's all I need proofwise.

The thing that keeps me away from ebay is the lack of arbitration. At least here on AT the social pressure of making deals right prompts many traders to do the right thing. It is not perfect, but my experience here has been much better than auction sites like ebay.

sorry to hear about your situation.
After reading so many horror stories about lost mail, if I need to pay via money order, I now use Bidpay. It cost about $2 more than the a regular money order but at least I don't worry that lost mail or seller pulling this cr@p. Plus, they send MO overseas.
