If she's that retarded, she should come over here and protest during deer season. Deer hunters don't use little pellets...

Seriously, the hunter should have been more careful.

Looks like he got her right in the mouth, How much more careful could he have been? Perhaps it was just getting daylight and he was looking into the sun. Why the hell would she be standing waste deep in the water with duck hunters around?

did you read and understand my post about how your judicial system is based on the principle of "innocent until proven guilty"? why shouldn't that principle apply to something that happened in another country... I mean, instead of outright blaming either of them, people should let the police/prosecuter decide who's at fault here.

The updated story:

UPDATE: A PROTESTER was shot in the face on the opening day of the 2011 duck shooting season in western Victoria this morning.

The incident occurred on Lake Buloke, about 12km east of Donald.

The protester, Julia Symons of Melbourne, was accidentally shot in the face while the shooter was aiming at a low-flying bird.

She staggered into the arms of two friends, saying "I've been shot, I've been shot". She was carried from the water with pellets still stuck in her face and one of her teeth shot out.

Once on the stretcher she said "I’ve lost a tooth, will I be all right?".

Ms Symons was also shot in the hand.

None of her injuries are life threatening.

One of the friends, Kia Matley, said she saw the shots fired and although the gun was loaded "he was aiming for a duck".

The other, Jessica Morris, alleged the shooters near her had been aggressive all morning.

She claimed one of them said to them "I've shot a duck. Hi girls, how do you like that?"

The three protesters were waist deep in the water when the accident happened.

Protest spokeswoman Lyn Trakell said it was Ms Symons’s second protest with the duck-rescue group.

Ms Trakell said this was the first time a protester had been shot in the 20 years of organised protests.

A teenager member of the Australian Cypriot Sport Shooting Associtation has been interviewed by the police following the shooting.

Rod Drew of Field Game Australia chief executive said "we don't want accidents and it's tragic that this has happened".

"But the reality is, we have raised these issues for years of people going into the water to protest," he said,

"We respect their right to do that, but wetlands and guns is not the right place to do it.

"The protesters continuingly break the human safety laws by going into the water before 10am and very few of them understand the safety zone of a shotgun."

The woman was shot at about 9.20am.

Inspector Gerry Bennett of Swan Hill police said a teenager was being interviewed and officers had also taken two men into the Donald police station for further questioning.

Insp Bennett said there was a lot of confusion in early witness statements and it would take some time clarify.

Well, this seems to indicate she was at least somewhat at fault since it appears she was legally not supposed to be in the water at that time.

Still, the hunter needs to be sure no one is in the field of fire.

That is like saying a driver should get in trouble for hitting someone trying to cross a freeway.

It's like someone jumping in the line of fire of a shooting range. She's at fault. She broke the law. Hunter was just doing his thing.

The hunter saw people in the water and decided to shoot anyways. He knew what he was doing.

If you are hunting a deer and person steps infront of the deer, you can't just decide you are going to shoot them to get to the deer. This is basically waht the shooter did. He saw her, he aimed, and he shot her.

Please quote the article where it says he knew she was in front of him.
