was arrested on Thursday after he asked security guards there for help retrieving it from a ledge on the famed skyscraper’s 36th floor

i thought the same thing. the dude is definitely a dumbass but wouldn't a ticket and hefty fine be more appropriate?

I don't even know if that much is necessary. I mean, maybe it just got caught in a gust of wind? Why didn't they just get his damn drone for him?

I'm admitted short on facts here, maybe he was flying it unsafely or something, but it just feels shitty.

PUNISHMENT & SENTENCE OF RECKLESS ENDANGERMENT
Obviously, the magnitude of the punishment for any crime is a severe as that handed down by a judge, but the sentence must always fall within the parameters of the law. As a misdemeanor crime, Second Degree Reckless Endangerment carries a sentence of up to one year in jail. This sentence never waivers. Meaning, you could have a prior criminal history or not history at all and the maximum sentence you could receive would be one year in a local or county jail (Rikers in NYC). Keep in mind, however, that even if the maximum remains the same regardless of your criminal history, a court or prosecutor will no doubt take that history into consideration.

First Degree Reckless Endangerment is quite different than its misdemeanor counterpart. A felony, NY PL 120.25 has no minimum for a first time felony offender and a maximum of two and one third to seven years in prison (2 and 1/3 to 7 years). As such, a judge could sentence you to a conditional discharge, probation, one to three years, two to six years or some variation that does not ultimately exceed seven years in a New York State penitentiary.

Keep in mind that he easily could have seriously injured or killed someone walking below (he's lucky it got stuck on a ledge).

Depends on the drone. Some of them weigh like 5 ounces. Very unlikely to injure anyone.

The drone had to be hefty enough to handle the wind tunnel effect the buildings sometimes create. A 5oz drone would have likely ended up 30 blocks away.

Drones that fly that high and take decent pictures generally weigh about 1KG + .5KG.

So 2lbs of plastic hitting someone on the head from a 35 floor fall could seriously injure them.

So if I lose control of my car and drive it into a ditch, and I call a wrecker to pull it out for me, they should call the cops because I could have run someone over, even though I didn't?

YMMV I guess, I remember even in the 70's seeing some pretty huge gas powered RV hobbyist planes that would be capable of carrying a pretty large payload.

But even randomly having a 2lb RC/drone drop from that height would potentially kill someone pretty easily on a crowded street.

Used to be a drop a penny off the Empire State Building thing and kill someone potentially, even prior to the interwebs.

Not sure if was a myth or not, but it would build up velocity.

Agreed. If it was small enough that no one noticed it hitting the building until this guy asked the guards for help retrieving it then it's not a drone.
